2nd hand car still not fixed pls help
Hi everyone,
I an absolutely desperate for some feedback to an issue I have with a car purchased just over 3 months ago.
I will cut a long story short and just say that I pointed out a fault on test drive, and had it written up in the pre-contract agreement that it was to be fixed before I took delivery of the car. Within days of picking the car up, the fault reappeared and has done several times since. The dealer has had the car back 4 times. Each time they have failed to fix it. I have said on several occasions that I wish to reject the car as they are in breach of contract but they wont allow me to. They have offered me other cars, some costing more than my original, but the cars they are offering are not what I want. I won't just take anything to suit them.
I have sent several letters, none of which they acknowledge. I have kept the finance company involved the whole way through, but they are not getting anywhere either.
How long is reasonable before I can take them to court? And if I pursue this..what are my chances against a dealer that I have since found out, has a lot of unhappy customers?

Your chances are likely to be very high to win the court case base on what you have said. Give them the ultimatum now, tell them to fix it or give u a full refund back. If they dont dont neither then tell them you will pursue it in court.0

Thanks for your reply..I feel like I am going mad.
I have found out today, when trying to track the details needed for a court case that the company changed its name in Feb 08 before I bought the car and didn't change their stationary to match...hence the company registration number does not match my details or anything they have on paper. How can this be allowed to go on?
I have advised Trading Standards, and they are advising me to sue the finance company, but I don't know where to start. The finance company are saying that they have to act impartially and get all their information before I can commence legal proceeding against them.0 -
