No refund at Tesco

I bought a shirt for DH in the sale. Kept the receipt and took it back yesterday for a refund as it doesnt fit. They wouldnt give me a refund because apparently this shirt would have had a cardboard tag on it, which it doesnt have now and they cant refund without it. We dont remember seeing any tags and wouldnt have taken anything off until we knew it fit.

Are they right not to refund?

    unless the item is faulty, a store does not have the obligation to refund...however, it if the shirt is unworn and in the same condition as you bought it, it has become assumed that stores will refund. you do not have the law on your side, but you could press on tesco's to offer a gesture of goodwill - if you do not get help with the store, perhaps call CS and explain the situation. Good luck!

    Would it not depend on whether the shirt was packed away in the shop? If this was the case the customer could not try the item on in the shop, only at home, so would not know it did not fit until they tried it on.
  • moan to the head office they normally try and sort something out to kep your custom

    You could still try it on, just take it out of the packaging? :confused:

    Even if you couldn't (for instance, if the changing rooms were not open), you are still not entitled to a refund just because something does not fit.

    I agree with tessie bear, give CS a call, they are usually very good x

    In this case though it wasnt a shirt in packaging, it was a casual one so just on a hanger.

  • If all else fails go to Tesco and if possible 'liberate' the missing tag off another shirt.

    Or try a different Tesco.....you will find someone who'll refund you, just keep trying..
  • Go there on a Saturday ( Busy day) & try it again. If they mention about the Tag, then tell them there wasn't one. If they still are awkward, then question them "Are you calling me a liar?"
    Demand to see the manager.
    Or you could tell them that you had rang the Head office , who advised that the shop will refund your money.
    Or if you had paid by a credit card, then you can ask them to do a "charge back"

    A few months a go, my wife bought a set of knives after seeing the in-store demonstration. The money went through the Tesco tills & she did get her clubs points as well. I had already bought them in the past & asked her to return the ones which she had bought from Tesco.
    The customer services refused to refund her the money, telling her to send the knives to the company who did the in-store demonstation, even though that the demonstrator had told everybody that if they did like like them, they could always take it back to Tesco with the receipt for a refund.
    I told my wife to ring Tescos & complain - stating that you want compensation for wasting your time & petrol.
    But she went to Tescos and told them that she had rang their Head Office (white lie) who told her that the store has to give the refund-
    She was given the refund without checking out with the Head office!!!
    Some of the people who work in supermarkets make up their own rules -not just only at Tescos.

    Unless, as tesco do, they offer a contractual right to a no quibble refund as printed on the back of their receipts ;)

    "If you change your mind about your purchase, please retain your receipt and return it to the store with the product as sold within 28 days. Conditions apply to some products, please see instore for details. Your statutory rights are not affected"

    I presume the issue here is that the tesco employee is claiming the product is not being returned "as sold" because of the missing cardboard tag.
