On the market without a HIP? - you will be breaking the law soon

EPCs now required on all homes sold after 1st October.

Currently, properties first marketed before their relevant commencement date do not need an EPC, i.e. 3 bed property marketed before 10th September 2007 would not need an EPC.

This will no longer be the case from 1st October 2008.


It is the vendor's responsibility to commission EPCs
If you dont ask for discount you don't get discount

    What is the projected punishment for non compliance?

    Is it still £500 per day?

    The wording on this piece of legislation is wide open to interpretation, the DCLG have changed their statement twice in 10 days. Some say you have to have the EPC by the 1st October, others say you have to have it as soon as possible after that date.

    non compliance fine £200 from trading standards

    My father in law is selling his house that has been on the market since last year, got a buyer so does it really need to complete prior to October 1st? PITA if it does need a useless piece of paper as it is a renovation job anyway so most things will get changed.

    If the property is under offer and not being marketed, then you could argue that it doesn't need an EPC as the legislation relates to properties being marketed.

    Properties that are currently marketed without a HIP, can be marketed while the EPC is sorted out, this should be done 'as soon as possible', whatever that means. There is also no requirement for the EPC to be attached to the details of the property.

    What if you are part way through a sale ?? And it goes beyond the date.
