To leave negative or neutral...?

Definitely a neutral now. Not for the chasing, not for the comms (even when they became excessive), but pure and simply because of the sheer volume of dodgy explanations, especially the highly suspect "close the dispute" part and because desipte confirmations that it was sent twice, it was not.
I've turned full circle now and am tempted by a neg, as I'm very suspicious of their motives for asking you to close the dispute. Would you have received a refund if you were a little more naive? Still, I suppose you have your money and the rest is all supposition, so a neutral.0 -
Alls well in the end and I just received a full refund (still no sign of the goods supposedly posted on 1st and/or 12th Sept). As I have a refund I definately wont neg but am still considering a neutral (as they now wont affect feedback rating) - the reason for neutral is due to all the emails, chasing for delivery, misleading info, wrong dispatch info, saying no more in stock with 61 on ebay at present, having to fend of phone calls and several daily emails and then having to open paypal dispute to get refund.
I'd definately neg because of what I have underlined above. You said it yourself, you had to open a dispute in the end to get a refund, why on earth does that deserve feedback that won't affect their rating?
IMO it went beyond a joke when they asked you to close the dispute so that they could refund you.
I hate being lied to so that in itself is enough to warrant a neg from me.
You also said in your first post.....*On otherhand I feel bad as it would be their first neg but if everyone thinks like that no-one would receive a neg.*

A late item on its own is one thing, but the lies and runaround compounded their error...0 -
UPDATE
The seller contacted me to say they had these items back in stock so I ordered two packs (same as before) - by this time the seller had refunded the original undelivered order and as I had received refunded I decided not to leave neutral or neg feedback until I saw how the second transaction went.
After paying for the second order the seller started emailing me 2-3 a day asking me to leave feedback for first transaction saying not to leave neutral or negative since they had refunded me (after several weeks and a paypal dispute) - feedback is optional and this transaction did not warrant a positive anyway so I was annoyed at this harrassment from her. Anyway today she has refunded my payment for the second order saying she no longer has these items in stock (despite still having 58 still listed in her auctions) - so I am now thinking she had no intention of sending the second order and I very much doubt she sent the first one now either.
As I received the refund I have now left neutral for the first transaction but want to know how I can do a non-performing seller claim for this second order and also how I can report an item that the seller is selling but does not have (heard before that ebay dont allow sellers to do this and you can report them ???). Have only left feedback for one item so if she harrasses or complains I will neg for the other item - also can I leave feedback for the item she rejected payment for (second order)?

Forget my earlier post and send them a big, fat, juicy NEG for this transaction.
Then go back to the previous transaction and add a follow up comment on the feedback you've already left. This will really stand out too.
Ebay's link for reporting a NPS should be relatively easy to find. Perhaps on your transaction page? Sorry, never had to do one so can't advise.
As far as reporting items seller's currently listing, there's a report button at the bottom of the item description. I have used this one, (seller adding VAT to final sale price,) and it's pretty easy- a series of drop down boxes and a space for comments I think.

I can see the section for complaining about an auction for copyright or listing violation etc, but none of the drop downs say anything about selling something they dont have and none of the options even have an 'other' section so i'm lost as to which to choose.

A neutral for the original transaction - the f/b on the recent transaction is o/s and it's hard to see how the seller's going to manage to squirm out of a neg there

The seller may have been telling the truth about the ill friend (although its personally doubtful in my eyes) but I did receive a refund so felt neutral was the fairest option - I would have negged had I not received my money back. The seller then contacted me last week to ask if the order had arrived yet and to say the items were back in stock if it had not. I had bought from her a while back no probs so thought I would give the benefit of the doubt incase this was just a one off. I now agree that negative should and probably will be left as this second transaction proves she is a bad seller IMO - I still believe a neutral for the first transaction alone was fair as I had a refund but if you take into consideration this second one then yes she is out of order.0 -
I'd definitely leave negative feedback. Having phonecalls just because you asked for a refund? I wouldn't appreciate that because I buy and sell online when I want as little human contact as possible!
Maybe they had sent it and were hoping it would arrive, but sometimes you have to cut your losses when selling on ebay and it sounds like they harrassed you which is out of order.
I know what it's like having sold a load of stuff on ebay, then having a crisis and making buyers wait but I have always told people immediately and I always send stuff recorded so it can be tracked. And having had so much of my post stolen I request recorded delivery from buyers too.
Thing with the new ebay legislation means you can leave whatever feedback you like and the seller can't leave neg back. If you get any comeback then you can always call ebay or email them and they will be very helpful and will definitely be on your side.0
