Hi hope you can help
OH got a car from one of those yes car credit places, but after a few months his cicumstances changed, after phoning citizans advice we found out that there was nothing could be done, he started falling behind on the payments, the company then sent a letter basically saying if you send the car back no we wil wipe the slate clean. OH thougt that this was the best option and arrainged for them to pick up the vehical, this was nearly a year ago. Problem is it now turns out that they sent this letter to us by mistake (theres not ours) and we got a letter from a bailiff today asking for £6000. When we found out it was sent by mistake we phoned and the woman at the company said just to keep it in case they try claiming any money of us. Like i said today we got a letter of these bailiffs and i was just thinking of sending them an email with the copy of the letter, showing we have this letter and we knew that there would be recriminations we would have somehow found the money for the payments.
Do you think this will work? Has anyone else had any thng like this?

Have you got the original letter from the car credit place saying 'if you send the car back no we will wipe the slate clean'?
If so, send the baliff a copy of this letter stating strongly that they have no right to pursue you.

yes we do still have the letter, like i said i was going to scan on to computer and send it as an attachment showing this. Send the copy to the bailiffs as you plan. Not only was this letter sent to you, but the car was then collected and no more payments requested.
I think they are just trying it on and probably think you would have destroyed the original letter.0 -
Email it but also photocopy it and send it recorded delivery too. That gives you something in hardcopy to produce in court.

hi, thanks to those that helped with this original problrm. think is we sent the e-mail and this morning we recevied a letter or the debt recovery team saying "Following our recent communications we are now instructed to take whatever steps are necwssary to recover payment of this debt"

I still don't think they have a case and perhaps you need to get a solicitor to write you a letter. It looks to me like they are trying to bully you into paying up.
The thing with this particular situation is that you had no reason to believe the letter was wrong. If, for example, they had written saying okay keep the car and we will cancel the agreement with no more to pay, it would be reasonable for them to argue now that most people would have known that was an error. In this case, I can see no reason why you should have thought it was an error, not least because they came and collected the car.
I think they will have to stand by their original correspondence releasing him from his agreement, but that they will not give up without a fight.0
