DCA phoning daily. How to handle them?

background to the story

I ordered goods from Next earlier this year and phoned up to get them collected.Nobody turned up.
I know I should have phoned them back but i was going through a hard time with depression and just didnt feel strong enough to argue with them.
As far as i am concerned I dont owe this money, its their fault the goods were not collected
So after ignoring phone calls from Next's own debt collection dept I have now been passed to Frederickson International. debt Collection agency, how have taken to phoning every day.
I have never even so much as had a late payment before and I have no idea how to deal with this.

Any advice on how to proceed would be great.

Start by writng a stiff letter of complaint to the CEO of Next and demand that they collect the goods, sort out your credit record and call off FI.

If you still have the goods and they are in returnable condition, then write and give them a date by which time you want them collected.

Or post them back, signed for delivery, with a covering letter explaining everything as you have done here.

If you havnt got them, send a letter to NEXT ( not FI ) and make an offer to pay a small amount each month. This has worked for me before, all they want is for you to be out of their hair.

How much are we talking about?

  • hi - just to say - you can take the goods back to the store - they might say you should have done that, rather than not let them be collected.

As it's gone to an external Debt Collection Agency, it might be worth starting off by seeing if there is a CCA in place, the chances are there won't be so it will be passed back to Next (or at least not pursued by the DCA) which will give you some breathing space.

I've had the same problem with FI, I'm so special to them that they bought two of my debts. The first one they didn't have the CCA so they've been silenced that way.

The second one (for a fraction of the amount of the first) they wont shut up about. I just told them every time they phoned that I was only prepared to communicate in writing and hung up. One of the women started shrieking down the phone about how many times they'd written without getting a reply. That was once, and I'd only had the letter a few days and hadn't had chance to get the info they wanted together. Pretty rich of them since they've ignored all my letters about the cca on the other debt! In the end the message has got through and they haven't phoned for a while.
Unless I say otherwise 'you' means the general you not you specifically.
  • Hi
thanks for your help so far.

    The debt is for £236.01

I was goning to return the goods to the shop, but i noticed on the dispatch note they had to be returned with 10 days not the usual 14,so i phoned up and explained to the customer service man that i hadnt been aware of this.He was the one who said i will arrange collection for tomorrow then.I waited in all day and no-one came.

how do I go about seeing about a CCA?
I have never had to do this before.
