they will give you it willingly simply request buyers details after the auction has ended.. then ebay will email you what they have on file..

buyer and seller address and phone number are emailed to you

It's a sellers details I'm after and exactly how do I request the details from ebay ie what's the path from the item description??

I cannot believe that this question is being asked. Of course it is legally binding. Why even bother to use it for buying or selling stuff by auction if it is was not legally binding?

If the bids are legally binding why do ebay state some categories are exempt from that rule? (law)

Why bother because its the minority that cause the problems, Most buyers and sellers are genuine.

eBay email their phone number and geographical location, not full address.

Check to see if they are selling any cheap (e.g. 99p) items. If they are, you ca buy one, and then get their address. A bit of a long shot, but you can easily have a look.

Is this a business? If so, they will have contact details on a drop down in their listings.

I cannot find your OP so not sure what you need the seller for.

  • " I got the ebay buyer's postal address from eBay and went to Moneyclaim Online " ... that's a breach of the data protection act and the other guy can bring an action of his own on that one. Also I'm not so sure the court will find in your favour, not just because you have obtained this information illegally but you still had the goods plus an auction is based on "sold as seen " and as this is an internet site nothing has actually been " seen". Also you chose to sell it at a lower price rather than put it back on eBay. Good luck with the paperwork but I wouldn't hold my breath. Most courts seems to take the view that as you still have the goods you can easily relist it so you're only loss is your eBay listing fee's. And that's the answer really - if the other guy hasn't paid then simply re-list it.

Probably need some precedent set in court to find out for sure.

It has already been set. There was a case a while ago involving a Jetski that sold for silly low money. The seller refused to sell, the buyer sued them for loss of bargain. Therefore the precedence has been set that when you bid on something, you form a contract if you win..

Reality is most won't take it to court but some sellers would.
