Injury at work

Hi.............

Hope this is in the right place

Could anyone tell me if I could make a claim against me ex-employer as I injuryed my knee slowly over time while doing my job. My job was delivering shopping for a major supermarket which included delivering to flats with or without a lift.

Some flats could be up to eight flights of stairs, we did have a drivers meeting where we complained about this but was just told it is the nature of the businnes and we are not going to stop delivering to these customers.

I went to see my doctor and he said I advise you not to work as I believe you have torn your cartilage so I am going to send you to a knee specialist so I informed my employer who decided that I should not continue to work as they would not take a risk on my knee giving out again and advised I should claim ssp.

I have since seen the specialist and has said I have not torn my cartilage but I have damaged my knee cap and he said there is some cartilage behind the knee cap and this is the problem. I am going for a MRI to se the how much damage I have done and if any cartilage needs to be removed but other than that thats it.

I can not walk up the stairs any more without knee pain so I have a take one step at a time using my good knee first, I can no longer ride my bike, I went to the science museum and after a couple of hours my knee was very sore so I came home.

I have been off now for three months and decide to look for a job I can do as I can longer live on 240.00 a month and I am just about to start this a job.

Any advise would be grateful.

    Did you report the injury to your employer at the time of that you were hurt? If not, then I am afraid that it would be very hard for you to prove that you were injured whilst at work as they could say that you injured yourself at home.

    I am not a personal injury lawyer so I would suggest that you contact one for some advice.

    Once I had been to the doctor and he confirmed I had a problem I informed my personnel manager of what had happened, when and how. At this same meeting this is when we decided I should be off work due to the risk of me falling down the stairs if my knee gave out.

    So you informed your employer that there was a problem, and they acted suitably. I'm not sure what else you want them to do?

  • Em well the fact that they would not give us help when carry food bags up six to eight flights of stairs four times each delivery, this has caused my knee problem and I feel that even though we told them we could not keep doing this they did not listen.

    Due to this problem I have lost three months wages and my mobilty!

    But you needed to tell them if you were having problems, not just have a group moan about having to walk up too many steps. There is a great difference between the two.

  • Ok.

    We did tell them about the problem as I have already said twice but was told sorry thats the job. Also we had no training on how to lift heavy items or how the load the vans when carrying heavy items.

    I have already spoke to a Injury lawyer and they feel i have a very good case I just wanted some advice.

    I am asking for help not stupid time wasting comments.

    If you’ve got an injury leech, sorry lawyer, on your side what on earth are you doing here?
    You are getting free advice and action from a qualified professional. What more do you expect?
    As an outsider looking in I originally had some sympathy for your plight but also thought that dmg24’s replies seemed quite sound pointing out areas of concern which might jeopardise your case.
    Now I think you are the real waster and abusing people who are trying to help you is really nor good enough.

    Possibly - possibly not

    Understandable from the companies point of view if they are in the delivery business

So you have been signed off by your doctor? Did your company make an offer for you to do any other type of work?

    Have you handed in your notice? Does your new employer know about you medical condition?

    Reading your other posts, if the company have given no training then you could indeed have a grievance against them. They may well counter with the fact that the items were not sufficiently heavy to warrant specific manual handling training, not a good defence.

    If you have a lawyer on board already I am not sure what extra advice you expected here? If the lawyer advises that you have a good case - sue away.

    I take it there was no union representation at the company?

    Do you mean full OF inbreds? Or inbreds that are full?

    Yet another person who posts on here just wanting to hear that they are right, the employer is wrong and they will get a fortune in compensation.
