What sort of evidence would I have to provide to show that it was his debts the loan paid off? I have a copy of his bank statement (just happened to scan it onto my computer!) showing the cheque going in and where the money went to but as the bank accounts and credit cards weren't in my name I won't be able to get any more information.

I think - and this is just my opinion - you 'allege' that he has paid his debts off with the loan money. You have proof of the money coming in and going out to various places. It is then up to him to prove that they are not just his debts - IFYSWIM...and you should still apply for legal aid. I understand what you mean by "allege". Until the court actually say it is proved, it is alleged.
The bank accounts and credit cards were all in his name. I had spare cards for his credit cards but don't think I ever used them. Don't know if he could prove that I did or not but the statements were in his name only.
When I tackled him about not paying the loan he said that he had had to use the cards for both of us to live on when there was nothing left in our accounts, so I expect that would be his defence. The fact is that I have far less income and the mortgage payment has gone up £150 and I pay all the other bills, etc without a problem, which I hope will prove that it wasn't me wasting money...
Probably accademic anyway, he probably won't file a defence, or if he does he won't turn up in court and then wouldn't pay me anyway.0 -
He's been for his first contact visit today with our 1 year old and was really horrible to me for the whole 2 hours. Crowing about how he had 'forced' me to let him see her by going to court and that I can't confuse contact issues with financial issues! He refuses to pay out any more money to me for the loan or the mortgage, says I can afford it and he can't!
I can't stand the idea that he can have rights without any responsibilities. I spend all my money on keeping a roof over LOs head and he pays the minimum he can through the CSA.
I'm going to ring my solicitor tomorrow. I have to get more money out of him for the baby's sake.0 -
just a thought, next time he visits have a mini tape recorder(ir your phone if it has this function) recording what he says.Cats don't have owners - they have staff!!
