I have heard back from Endeavours solicitors saying that they will accept my payment offer. However, they say that "In view of the arrears on your account our client has instructed us to continue with the proceedings to obtain a possession order. However, our client will agree to this order being suspended on the basis of your making payment of the agreed sum each month. This means that our client will not be in a position to take possession of the property, on the strict proviso that you maintain the agreed payments".
Is this normal?

This is how my mortgage situation was going to be dealt with. Just make sure you keep up the payments you have agreed as they will be able to take action very promptly if you don't. Make sure you keep proof and a good record of all the payments you make.

I made the first payment last week for the amount due each month and the amount agreed for arrears. Direct debit set up to start next month for the usual payment plus the amount for arrears, or so their solicitors told me.
In court tomorrow so hope this is enough.0 -

Everything went fine. I have a suspended possession order, so as long as I keep paying the agreed amount everything will be fine and once the arrears are paid off then it will disappear.
The solicitor for Endeavour was really nice. He said it was disgusting the way may ex was treating me and explained everything to me.
The judge said I had been conned and should take legal advice about suing my ex to get the money back from him, if he has any! He thought I had a good case as the money was used to pay his credit cards, overdrafts, etc.
I'll have to see if I can afford it and talk to my solicitor.

Oeillade, do you have home insurance - check for legal cover, you may be able to take court action against your ex through your home insurance. I took an ex employer to court through this and it was invaluable.
You really should take some legal action even if it means borrowing the money from a relative as it seems as if you have been conned completely...in fact I would go so far as to say report him to the police.Quality is doing something right when no one is looking - Henry Ford

I already get legal aid as he took me to court to get contact with my daughter, so I don't know if I would get it for a second problem at the same time.
To think, I have to allow this person access to my beautiful baby daughter. He wants his rights but he won't take any responsibilities.0
