    I wont be claiming anything on insurance if I can help it. 3 claims in 4 years due to the flat above having plumbing issues left me almost unable to get insurance for our new house.

    As for the source of the damp, I need to get up into the loft tonight and out to the eaves to see if there is any indication that the leak around the chimney is the cause of the damp but I suspect its not related.

    I realise its digressing a bit, but leak from flat above? Shouldn't your insurance company treat these as third party claims?
    My suggestion and/or advice is my own and it is up to you if you follow it, please check the advice given before acting on it.

    Well you have thought so but thats not the way it works. Unless the people upstairs have been negligent (and you can prove it) then you have to claim on your own insurance :confused:

    Kinda sucks but not much you can do about it. To be fair the new owners who caused the second two leaks did pay my excess.
