    Hi all
    posted on CCA about 2 weeks ago and was advised to send letter to Mackenzie Hall requesting copy of alleged agreement as per above and got standard letter back saying they were dealing with it and should forward information within 30 days. Checked back on forum and advised to send 12 +2 days letter at end of period - which is Friday 27th June.
    OH has now received letter from Cabot Financial saying they acknowledge request for information under the CCA and say they have asked the original lender for this information and anticipate that they will be able to provide this information within 12 days. If not, they will write to us again. Letter dated 20 June, but only received today.

    As the MH letter is due to be sent on 27 June - do I send a copy of that letter to Cabot as well, saying that they have not responded within the time period (have letter saved from forum board) ? :confused:

    Yes - send the 12+2 letter to MH. MH have acted contrary to the OFT Debt Collection Guidelines, as well as in contravention of the terms of the Consumer Credit Act, 1974, by passing on your details to a third party - Cabot Financial, and you wopuld e well within your rights to report them to Trading Standards.

    Do not be put off by any letter which says that they need, or request, extra time. If they are pursuing an 'alleged debt' then they are legally required to provide you with a true copy of the original cca within the prescribed time period, whether they are the original creditor or not.

    Letter to MH being sent recorded delivery tomorrow so they get it on Monday. Couldn't post it today - at a funeral, so trip into the main post office tomorrow.

    Letter received yesterday by MH. Obviously not impressed with the brilliant letters we have been sending then, because the letter was just addressed to the postal address - it even said Dear XX xxxxxxx Road!!!
    Still haven't got a copy of the agreement from their client and will close the account if they haven't received anything in 28 days. Will be sending off the 12+2+30 days letter to them in due course:j

    Obviously MH are telling CF whenever we correspond with MH.
    Have received letter from CF today thanking OH for our request for information. The letter from MH arrived on Saturday.

    "Although Cabot has requested the information, the original lender is expriencing a delay in retrieving the information from it's archives"

    So the original lender is Barclaycard, they obviously then sold it on to Cabot, who in turn sold it on to MH - Great fun
    Hope that the archives are in a mess.

    Hi all

    Had a nice surprise when came home today - a letter from Cabot Financial stating that "Cabot have requested the information, the original lender is experiencing a delay in retrieving the information from it's archives"
    What a shame......
    Obviously have worked out who is who in the pecking order.
    Barclaycard sold debt to Cabot, Cabot sold this on to MH.
    Still only corresponding to MH
    Roll on the time to send 12+2+30 days letter

    i started recieving letters from a company called lowell portfolio about 2 years ago, they were asking of over £800, i paid some of it like a fool, without evidence or written proof, they said on the phone the original creditor was from loyds bank, but i refused to pay as it was over 13 years ago that i was with loyds bank, but now mh are sending me letters and ringing me, they are really hounding me like wolves, id appreciate any advice.Andy
