TDS. Court - Yes or No?

  • 6 Month Assured Shorthold Tenancy. Which is now over.
  • Tenancy was signed after April 2007.
  • LL did not put a deposit into a scheme. Even after being informed of tds.
  • LL did not return deposit. T gave LL sufficent time for the return.
  • T sent numerous letter's to LL, eventually the deposit was returned. Plus £10.
I feel I'd like to take the LL to court to stop him from treating other tenants the way he treated me. If I decide it's worth doing, I'll use the online service in the morning.

    You can try, but there's been no successes in getting 3x deposit where the deposit has been returned, however late.

    and if you lost, you'd have to pay costs for the landlord as they have repaid the deposit plus a compensatory sum (apparently).

    what would you take him to court for ? you have not suffered any financial loss - you have made £10 profit - move on with your life and forget it - not worth the hassle

    He did wrong by not protecting it, but you got it back now, plus £10, so I doubt the court would rule in your favour as they might see it as being petty.

    It would be a waste of your time tbh, so best to move on...

  • Your deposit refund probably came from the next Tenants deposit. That will be why it took so long.
    I am a Mortgage Consultant and don't like to be told what I can and can't put in a signature so long as it's legal and truthful.

    Regrettably, I don't think you'd be successful with the case.

    If your motive is purely to stop him doing it to other tenants then send information to the Private Sector Rentals Team at the local Council.

    Write to your MP, and your local Councillors, and Shelter. They need to know when and why the legislation is failing tenants.

    What are you attempting to sue for?
    What are your quantifiable losses?:confused:

    You paid the LL a deposit and the LL has now returned that deposit in full.
