buy or not to buy

We are currently in rented two bed flat at the moment, nothing to sell and have recently 'negotiated' a £40k discount on a new build house. I've read the forums about buying new build and having had issues about new builds before, the current circumstances of no space, second baby on the way (due Feb 09), it seems like a possible option certainly from the wife's perspective. Renting is quite expensive in the area.

The builders are quite arrogant in that they still believe they will sell the houses and the sales woman says they are cash rich. Apparently their other businesses are keeping the building business up. But since Jan 08 I think they have sold about 3 houses (on houseprices.co.uk). They are also saying the discount of £40k is for a completion by the end of the month. Our solicitor thinks this is unrealistic, but low and behold the builders know a solicitor who can do it in this time so the are not willing to move on this date.

I'm annoyed at their attitude and as being new build I was asking about any covenants/restrictions that might be in place as we are looking at extending over the garage as it seems a 'cheap' option to get more space and the price of their 5 bed houses are clearly overpriced. It is further complicated by being leasehold and they are the lessor at the moment, until, we are told, all the houses are sold. We spoken to them about this and after many phone calls they are 'allowing' us to see the leasehold document but we can't take it away. As they have been asked the question about the garage extension (not sure it was the right thing no we think about it) they will not provide anything in writing regarding this. So we are thinking that they could get the sale and then deny through the leaseholding to allow any changes to the property?

What comments/advice do you have on this?

    This sounds terrible. They are trying to bounce you into not using an independent solicitor - and then won't give you a copy of the lease - and what happens if they don't sell them all? You would need planning permission to extend I imagine, so you could visit the council planning office for some advice. You have got a long time to find somewhere else (little babies don't need any space, because they don't go anywhere) so why don't you find some other options...

    You know that walking away takes courage but will pay rewards in the long term.

    So they think they can hold out whilst others are dropping prices all around them?

    Whether they were selling new build or old (for all those slating new build, in some areas they're the same price as an older period property!), with an attitude like that I would stay well clear.

    Take your money elsewhere!

    two more points.....
    1. its a buyers market (despite some vendors not realising this yet)
    2. houses are like buses there will be another one along soon!
