No, it's the landlord's responsibility to give it back. Again, the *landlord's* responsibility, not that of the letting agent. So even if the LA doesn't give the deposit back to the landlord, the landlord is still personally responsible for returning the deposit to the tenant.Wouldn't the easiest thing to be for you to give a letter to the tennants saying you are happy with the condition of the place and for them to follow it up ? it is in a way there position to seek it back
OP, this is why it is so important to use a good letting agent - because although they can manage the property on your behalf, ultimately you are responsible. It sounds like this LA is doing something slightly dodgy, since if the deposit was in the scheme as they say, it should be absolutely no trouble for them to sort out its return. You are their customer and you need to put your foot down with them.0 -
The deposit is 100% with the DPS as the tenant has the login details of his account and can access the information.
On a side note, how long does it take to transfer ownership of an account if i got the letting agent to transfer the ownership of the deposit to me?0 -

That would be very difficult. If the OP gave the tenant their deposit back from her own funds, the LA would have to ask the DPS to return all funds to them. The tenants would then have to agree to this, or it would go to dispute. Finally, even when full funds were returned to the LA, the OP would still have to claim them off her agents.
It would be far simpler for her to go into their offices & make a fuss until they take the two minutes to enter the repayment ID infront of her.
The tenants could also take the initiative, & start a single claim process with the DPS. Have they written to the agent? If so, was this over 14 days ago? They need to get a statutory declaration (costing about £5) and follow the procedure outlined here and here
OP - re transfer of ownership of a deposit, the agent who is controlling the deposit needs to initiate the transfer. Info here . This will probably take longer than getting them to enter their repayment ID, which rather defeats your object0
