IB underpaid for >12 years - LUMP SUM!

  • Interesting link - going to ring IB tomorrow and see how they're going with things.
    I only said 8% as that's what the courts use - I agree they're probably going to maybe round up the lump sum.
    Have already said to them that Mum's future payments (every fortnight) need to be adjusted.
    Stazi I agree with everything you say, but I would be very surprised if DWP don't try and drag this out (hope they don't but expect they will). Of course if they had overpaid her for 12 years then they'd take it all back and then some, but as many on here will vouch for, just because you're entitled to something, doesn't make it a given.

    Having read the link provided by suelees1, I don't think that DWP will be 'rounding' anything up- any comp will be paid to the exact penny. It would appear to be a very complex calculation that would be done by a special team, as the comp is going to be a special payment.

    It's unlikley to be done by the staff that deals with her IB claim.

    If anyone is overpaid due to 'official error', then I think all DWP can do is ask for it back, but they would be unable legally pursue it. An error on their part is just that. Fraud/mistake by a customer is another matter.

    I made some enquiries myself and found that it's listed on the benefit statement as Invalidity Allowance less Additional Pension, didn't know that it was the age allowance

    I found it was simpler in the days before direct payments with the old Order Books which listed every element of Incapacity Benefit. There were eight of them from A to K. An old Order Book of mine lists them as;
    A = Basic Rate
    B = Graduated Pension
    C = Increase of Benefit for an adult
    D = Invalidity Allowance
    G = Additional Pension Payable (after any Contracted Out Deducted)
    H = Age Related Addition
    J = Age Addition
    K = Increase of Benefit for children

    I was (presumably still am) on four of them A, C, G and K.
