BMI baby - claiming compensation

  • Well I have recieved a letter from BMI baby saying that I am not entitled to anything. In addition they did not answer any of the questions I wished to be addressed in the letter. However, I still have no money from them ! Is there a timeframe they must stick to for a refund ?

    In addition I have not heard anything from the ATUC either, so I have decided that next week I am going to start my small claims action. I am not sure what is involved in this so I have no idea how long it will take.

    What I find so fustrating is the fact that you have to do all the leg work to gte money that you are owed by such a large company and that they are allowed to get away with this.

    I will keep you all posted on how I get on

    Well still no flight refund or explanation of when I am going to get the money. Therefore, we have just started small claims court action against BMI baby to recover this money if nothing else. We have been waiting for over 3 months for this money so maybe this will speed it up. The only alterntaive to recover other charges such as carparking, fuel etc is to use our insurance.

    Not sure what will happen now but will keep you all posted.

    Here's the latest update in my BMI baby saga. As predicted BMIbaby have finally got back to us now we have started court action against us !. They have said that they are going to give us our flight money ! (outstanding since 18 July08) and that they will pay our court costs. We must drop our case !. We are thinking we should carry on if only to get the loss of interest back but what do other people think ? Any advice would be good !

    god i would be scared to take such a big company like them to court, you could end up paying more for the court costs in the end!! they will take it all the way, money wont be a prob for them. take your refund and run i say

    The OP will be using the small claims track. Costs are rarely awarded in such cases.

    OP, there is certainly no harm in taking the case further, but is it really worth the hassle? How much would the lost interest amount to? I am guessing not a great deal. Perhaps you could suggest to BMIBaby that they offer an amount in recognition of your inconvenience?
