  • You poor things, that`s so wrong. It`s horrible, isn`t it?

    There should be a law, enforceable within a week if they don`t act like a good neighbour. Kicked out on the streets, that might make certain people think twice.

    I hate the way the law is on their side... :mad:

    I am so sorry to here about your problem neighbours. I am an Environmental Health Officer and have had some experience of dealing with situations like this.

    I am sorry to say that I agree with anniehanlon - there are some people, with whom mediation is just impossible, because they are so totally selfish it is impossible to live along side them.

    Yes the LA Environmental Health Dept can and probably would take swift action where noise nuisance can be proved - eg loud music that can be easily measured, and heard by several people/properties.

    However, some of the nuisance you describe is much more difficult to deal with.You may be the only other person affected, as quite low level noise and regular anti-social behaviour can be extremely intrusive.

    Keep detailed logs of all incidents of nuisance/threats etc. If you feel the EHO is not taking your complaint seriously, get a local councilor involved.

    You will need to be extemely strong and determined to see this through to a satisfactory conclusion as it is likely to take a long time to resolve. Only you can decide whether you are strong enough to see this through.

    if this goes to court the local authority will need a "body of evidence" which can be difficult for them to collect - if it is only your noise diary it is your word against the tenants - you really need some other neighours to be also writing to the council and/or keeping noise diaries as well - and folks are often notorious in their moaning and utterly silent in their action - best of luck

    Hello everyone,

    i urgent need info on how to evict a tenant in a private rented property. He rented the property almost two years ago. intially the first year contract was signed through an estate agent, after which the tenant signed another 6months with the landlord. Recently, he started misbehaving and not paying rents on time. Last week, he approached that he want the rent reduced as Bank of England has reduced interest rate and if the rent is not reduced he's not going to pay any rent. In november, a month to the end of his 6month contract, a notice to vacate was issued against him and given him a month to the end of his contact(which is december). The man refused to leave the property and threathens to go to court if he's made homeless as the court will give him upto 3months to get a new accomodation before vacating the property.

    As the strain is getting too much for my brother(landlord), please advice on necessary steps to take. many thanks

    Why have you served one month's notice to quit?? An S8 or S21 is always two months notice from the landlord: if notice is not served correctly then you have to start from scratch. Court will not give him another three months unless he or a member of his household is vulnerable, but they will tell you to go away and serve notice correctly.

    Is your brother a member of a landlord's association? They will give him guidance on the correct procedure, otherwise you need legal advice. If you have mucked up the notice once already the last thing you need is inaccurate advice from randoms on a forum! Before you serve notice you must have lodged the tenant's damage deposit in one of the three schemes, as without this notice to quit is invalid. I would also suggest you check you have an in date gas safety certificate.
