New Car Help....please

Saw a second hand car I really liked on Sunday and decided to buy. Didn't have anything on me so phoned a little later and paid a deposit of £200 via debit card.

Was due to take delivery today but was called into work this morning and told my services were no longer required.

Phoned the dealer who was a bit peed off to say the least and told me that the car had been taxed and registered in my name.

I have signed no documents and the debit card payment was actually made by my OH

Have I got a leg to stand on please?

  • I was under the impression its free to register a vehicle and the car is taxed on the registration number. Give trading standards a ring or call in CAB and ask their advise.

    You've entered into a contract to buy it, so you need to go through with the transaction, legally.Or enforce court action, to regain the profit elemed't, at least.

    He COULD NOT,however have taxed & registered it in your name, without your authority & the provission by you, of a valid insurance certificate.

    Assuming you didn't do this, he's misleading you & probably looking to 'let you off' by keeping your deposit to cover his X's.

    Probably be the easiest/cheapest in the long run, if you can accept this.

    Guess you never saw an invoice, or terms condirions of sale?? On mine we print 'a non returnable deposit secures a vehicle for 7 days' most people are OK with this.

  • I don't expect the deposit to be returned but how can I have entered into a contract by simply phoning a deposit to him, not signing an order, not having t & c's explained etc, and would my signature be required on the registration document before it could be transferred into my name?

    He can't of registered in your name as vansboy said, but also he's highly unlikely to have done that before you actually have paid for the vehicle.

    Have a look through the Trading Standards website for what your rights are.

    I would suggest a visit to the dealer as it's easier to speak to them face to face.
