Note: I see that the tribunals are experiencing some problems with their on-line forms. If you cannot get the online form to work, you need to get a paper copy. Try jobcentre-plus (phone number should be in your local phone directory, or try yell.com) or phone the ET office gain and ask them to send you a claim form.I'm a retired employment solicitor. The nationwide chain will have procedures in place, and almost certainly would not normally treat an employee like this. Unfortunately sometimes managers go off on a frolic of their own, leaving HR to pick up the pieces. At that point, they will often close ranks and try to bluff their way out of a sticky situation.I'm a retired employment solicitor. Spoken to ACAS. because the 3 point rule has not been followed by give my daughter her notice we have a claim to lodge.
i have been told to write to her company telling them this and give them 28 days to reply, the E1 form is to fill in after we have spoken to the company, and only if my daughter does not want to go back to that job becasue of lack of trust etc.
so i will wait and see their responce now.

Also (sorry to bang on about this) do make a BIG note on your calendar to lodge the claim in time.
If you get letters saying things like 'the person dealing with this matter is on holiday and will respond to your concerns on her return' or other delaying tactics, lodge the claim anyway.
Delaying tactics by the employer are NOT a valid reason for missing the deadline and your daughter's claim would definitely be thrown out in that case.I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -

head office rang just as i was writing to them.
seems they have admitted to making mistakes in the matter.......suprise suprise.
hopefully aranged a meeting 3-15 today to discuss my girl going back to work.
however. she is adament that she will not go back due to breakdown of trust.
if she does not want to go back ill have to take the bakery to the ET.
looking good though.
