Unregistered landlord

Hello,
can anyone tell me what is likely to hapen to a person renting out a house who:

a) isn't a registered landlord
b) hasn't been telling the taxman
c) hasn't told their mortgage provider
d) hasn't been providing gas checks etc

Will they get into trouble or does nothing happen usually?

    Unless they're in Scotland, I believe, in which case they do need to be registered.

    Depends on the property type. Some types of house need to be registered with local councils (HMO) and the tax man can estimate your income and charge you tax if you owe any.

    It should be declared on your self employed income tax form - so you may need to do that.
    Does being a landlord count for national insurance payments?

    The sooner you tell them the better, there can be fines for not registering as self-employed.

  • I thought they'd changed the law to require landlords to be registered.

    Anyway, it isn't me it's my effing landlord.
  • Landlords in England (and Wales?) don't have to be 'registered' in any way shape or form unless they are LL's of an HMO (HOUSE OF MULTIPLE OCCUPATION) or are LL's of a property in a selective area, for instance, some areas of Greater Manchester have been recently designated as selected for LL licensing. This will no doubt be rolled out UK wide as time goes by resulting in all LL's being registered and licensed. To find out if you are in a selective area now, contact your local council.

    If your LL doesn't tell the taxman, then this is a risk he stupidly takes upon himself. They will find out eventually even if someone doesn't dob them in, especially if there is a paper trail and cash isn't involved.

    Not telling the mortgage provider is a pretty shoddy way to start up or continue in the letting business. This would indicate to me that the LL is more than likely ducking and diving his resonsbilities in other areas, unless of course he was a complete novice and actually didn't know they had to be informed first.

    Not providing gas checks is pretty serious and would also indicate to me that the LL is a ducker and diver and just in it for the money. I would go to CAB and/or Shelter and get further advice i.e. who to report your concerns to.

    Sounds to me like you are truly pi22ed off...has your LL protected your deposit? does he have the building fully insured under a LL insurance scheme? These are the things that will affect you on a more personal level if they are not in place.

    If you know who the LL has the mortgage with you can always send the lender a copy of your tenancy agreement. In the event of your LL falling into m/g arrears and any subsequent possession proceedings, it's important that you would be "in the loop".

    Failure to have gas checks/services done annually & produce a gas safety certificate ( which must be kept for at least 2 years) can result in a Mags Court/Crown Court appearance and a fine of several thousand K and/or prison (depending on surrounding circs) You can report the LL to the Health & Safety Exec or to the local Council, either of whom can bring a prosecution.

    I don't think landlords have to be registered unless it's an HMO.

    Their mortgage provider could call the mortgage in, if they do not have permission to rent, and if they owe any tax to the taxman they could be prosecuted (But as the tenant how do you know about these two things)?

    Thanks for the advice. The thing thats P'd me off is that they've just decided to hike the rent up by 25%. I wouldn't mind if the house was perfect but its far from it & they won't spend any money getting it fixed properly. Everything that gets done is done by cowboys resulting in substandard work, the latest "new fitted kitchen" was actually a free one ripped out of someone elses house & it's crap.

    I don't think I should be paying any more especially when they aren't even doing the basics like the gas certificate.
