Where have I said that the SOGA is a warranty.................. but depending on the retailer it can be a laborious fight.

I didn't mean to say that you personally said it WAS a 6 year warranty, but without stating the actual details many people are led to think that it is. You only have to look at some of the posts on this site to see that.
Totally agree with "laborious fight" !

I thought you was referring to me because you had quoted my post :o

I do agree with you that people do quote the SOGA without fully understanding it. I only had to correct a long rambling post yesterday of someone giving out incorrect advise in ref to the SOGA.

SOGA does not specify a maximum of 6 year warranty at all. The 6 year period is set out in the Limitation Act 1980 as the time within which to issue proceedings following the breach of contract.

    Hi All,

Hope I'm posting this in the right place.

We bought a Panasonic Plasma tv from Currys online in December 2006. It broke down in June 2007 and we had a replacement delivered on 31 July 2007 with a fresh 12 month guarantee starting from then.

Tonight while we were watching our current set, a vertical green line of, I assume, dead pixels appeared on the screen - it won't go away. The tv's now about 5 weeks outside of it's guarantee :(:(:(

I've been reading about the Sale of Goods Act on this site - I hope we've got a pretty good case under that so I'm going to ring Currys in the morning.

I've also seen stuff about alternatively making a claim against my credit card company under the Consumer Credit Act.

I'm going to ring Currys first but was wondering what I should do next - should I go down the route of sending letters to Currys then to small claims court or make a claim against my credit card?

Also, is there any particular wording I should use when I phone? Any advice gratefully received, thanks in advance :)

I can remember when people who's TVs went wrong just called a repair man and aid to have them, fixed, rather than expecting them to come with a free lifetime warrenty...

I don't expect a tv to 'come with a free lifetime warranty', thank you very much, but I do think it's reasonable to expect that a very expensive tv, manufactured by a company with an excellent reputation, will last more than 13 months. It seems that the law (SOGA) agrees with me. As do Panasonic themselves as they are repairing the tv free of charge for me.

I really don't appreciate you implying that I'm some sort of free loader for wanting to protect my rights as a consumer. This is after all a consumer website.

Thanks to everyone else for your constructive and helpful posts, your advice is much appreciated.

Saffstar - this guy is a well-known troll on these forums who goes out of his way to wind people up over emotive issues. You'd be better off just ignoring him rather than giving him the reaction he wanted.
  • Well after my last fight with Currys, my 10 year old was so angry, he threw a brick through the window on the way out. I said to them "Sorry mate it ain't covered as he's a minor" and promptly drove off.

Well after my last fight with Currys,

Are you going to revive every old thread mentioning Currys tonight, because it's going to get a bit bloody tedious.

You must be so proud of him
  • Saffstar, it could help if you get an uplift number of some sort of authorisation from the manufacturer of the TV to say that it's been written off. That would expedite your claim against Currys online.
