I am actually surprised that they would not go with the credit option since the amount of revenue they receive will be the same. Quick word of advice, this is a trivial matter so don't let it give you sleepless nights ... assuming you are not totally cash strapped for £12.99 then forget principle, forget the amount, forget how you perceive people have talked to you ... treat it as a bit of fun (I love these situations and usually end up dealing with them for all members of my family ... only yesterday my mum mentioned a problem which I am looking forward to sorting out at the weekend ... it will probably cost me more than the refund I am hoping to get ... but it is just a bit of fun).

I wrote this on another thread, it was intended for this one:

I note that you bought two at 12.49 or 12.99 and the free item was 10.49 and it is one of the more epensive items that became faulty.

So I wondered if as one of the items which you "bought" as opposed to "got free" is the faulty item, you should get a full refund for that item. The fact that the store chose to give you an item free of charge, has nothing to do with it, you paid 12,99 for your item which is now faulty. Refund due End of.

I'd like to put that idea to someone with a legal mind, I think it holds water.

It's more like the Titanic. :D The 'free' item was conditional on your buying the other one, so if the sale of that is cancelled, your entitlement to the 'free' item goes as well. Or, looking at it another way, you paid one price and got a package which contains two units of the same product. The store is entitled to get its full package back if gives you a full refund.
Eh?? I give up!! Towel is getting thrown in here! :D

Which, if true brings me back to my earlier post on this thread. That if the store wants to treat all three items as a package deal then they cannot refuse a claim for a full refund upon return of all three items just because one or two of the items have been worn. Which is the reason they gave to refuse the refund.

They either treat the lot as a package, hence full refund for three items. Worn or not one of them is faulty. OR they treat the items as individuals and refund on one item. They cannot have it both ways.
  • Hello again, this is how it went:

Friday 16.45 - posted the letter I mentioned in my earlier post
Saturday 11.10am - received message on voicemail from assistant at Woolies, asking me to phone back
Saturday 16.00 - I rang back, and assistant told me that had I returned to the store later in the day I would have been given a full refund for the faulty item (eh???), so I told her I would go in the morning.
Sunday 10.00am - returned item and received full refund at last!!

Pity for them that they didn't give me the vouchers when I originally requested them, then I might have still been a customer of theirs, and they would have still had my £12.99 but I am done with Woolworths now. I have requested all my very large family not to buy the kids anything Ladybird or Chad Vally for xmas.

Were the people who had earlier refused you there? What reason did they give for the way you were treated. Have the other staff been "re-trained"?

So you sent your letter to the local store?
  • #18 I didn't really want to go through it all again with them again. The staff are so stubborn that I think that they are beyond training. They did look a bit worried though when they saw me again.

At least I got my money back, and had the satisfaction of walking out of the store smugly.
