Halifax Offer

I started my claim back in July 07 using the great information on this site.. THANKS !!:T :T

I sent the letters claiming a total of £3641 (with interest), getting back the usual responses, saying that the charges are fair and what not!! I had just sent the letter threatening court action, when the claims were put on hold. Until recently when I read that you may be able to reclaim if you were in financial difficulties. A situation that I now feel I am unfortunately in..
I wrote to the back asking for a review considering my current situation. The letter I received in response was to totally ignorer my request and they refused to even look into the matter. I replied threatening I would take the matter further but again no response..
As I thought I had a case which the bank was failing to review, I phoned the financial ombudsman, to which they said they would look into on my behalf. (3 weeks ago)

No responce for the Ombudsman but today I have received a letter from the bank offering £2800 !!!! Yip Pee !!:beer:

In the letter there is this paragraph

“To ensure you are not disadvantaged by accepting this offer to the outcome of the court proceedings, we can assure you we have registered and stored details of your complaint. Once the legal proceeding between the OFT and the banks finish, we will review your complaint again, as quickly as possible, to ensure this offer reflects the courts findings. “

Does this mean I can accept this offer and still reclaim the outstanding amount (£841) if the courts deem the charges unfair, or is this a final offer ??

The acceptance form states..

“I/ We confirm that I/We accept a total amount of £££ in settlement of my/our unarranged overdraft bank charges complaint”

I would just like to say thanks again for everything. I couldn't have done it without the help of this site.. :T :T :T

    yes it is safe to take the offer. under the terms of the waiver they have to adjust the payment to reflect the result of the oft test case upon completion. if at that time it is decided you should have got it all back yu will get it and i presume the interest accruing in the mean time.

    Just before you send off that acceptance form, can I give you a bit of advice?

    I claimed on 3 Halifax accounts. The first 2 paid out the whole amounts asked and they were similar amounts to yours. The 3rd one came through with a 50% offer ie £1295 instead of £2300ish. It made no reference to the rest of the money in the letter. I phoned Customer Relations to query it and it became apparent that they had miscalculated. The upshot is that after a few days of troubles with their systems, I got the full offer - this was just last week by the way. From what I have seen on these boards Halifax have been paying out the full amounts.

    If I were in your position I'd give them a quick call just in case.

  • Hi, I am new to this site and have just been reading your post. I am trying to find out can you reclaim interest charges etc for using your overdraft? I am seriously overdrawn with HSBC and would like to try to claim back the interest and charges, I no longer use the account so dont mind if they close it down, just not sure where to start. Many Thanks
