Incapacity Benefit and going back to work

My partner has recently decided to go back to work after claming IB for 2 years. Then the DWP sent the dreaded IB50 form. The form has to be back soon and he still hasn't found a job, but can we really send it back claiming incapacity to work when we know he is jobseeking? Also when he does go back we will be without money for a month, i know they give £100 but that just doesn't stretch! Is there anything else we can get to tide us over otherwise we will be actually penniless with no food whatsoever and no money for bills or rent. I am just sick with worry at the situation we face anything anyone can tell me would please be a massive help! thanks

    There is no reason why he cannot look for work and claim Incapacity Benefit at the same time if he has a health problem. If he does not have a health problem anymore he should claim JSA. If he does get a job HB/LHA and Council Tax Benefit can be paid for the first month.
  • Hi,He will be able to do permitted work for a year, which means he can earn £86 per week, and work a lim ited number of hours (cant remember how many, sorry) and still recieve his IB.
    I did this, it gives you a taster for work, to see if you feel up to it.
    Ring them and tell them, they will give you more details,but it stops you fretting.
    Also,when you do give up the IB they pay you £250 for going back to work, (or thats what they offered me anyway).

    In addition to the £100/250 Job Grant, there is possibly also a Return To Work Credit (RTWC) of £40pw for 52 weeks to help.

    Both the JG & RTWC could only be payable if someone starts self/employment, and are not payable if they are disallowed because they fail the IB medical.

    The Permitted Work amount is £88.50pw for a max of 52 weeks, and the amount will increase on 1/10/08.
  • thanks everyone its been helpful. If he moved to JSA would it just be normal application and processing or could it be done a bit quicker as we have been on IB?
