Advice needed!

Hi Chaps

I have only posted a couple of times on this forum, I read lots though!.....anyway..

Me and my partner a few months ago joined payplan(they are excellent) and they took over our debts with £100 going to our creditors each month.

Now after a lots of phone calls and god knows how many letters from our creditors, they seem to have calmed down a bit. Now 1 DCA have phoned us constantly and written letters, now we received a letter today from their solicitors saying to us that they are going to take us to court if we dont come up with an agreement with the DCA.

As you can imagine we are a little worried, I did read on one site that we could ask for our credit agreement if we send in a £1 postal order, and if they failed to produce it they cant force this debt upon us.........how true is this?

    It depends what the debt is for. An overdraft won't have a written agreement so it's not use for that. You can request a copy of the cca for a loan or creditcard though.

    The debt is for a catalogue my partner got 6 years ago, which went to a DCA about 4-5 years ago.

    She has been paying them £40 a month, but just cant afford that now.

    How much was the debt? She has repaid over £2,000 based on your comments

    I will CCA them tomorrow, I dont know anything about charges, sorry.

    I cant remember how much the debt was originally....I will try and find this out.

    So do I have to give them 2+12 days to reply? and after that date comes and goes and we still havent heard from them then what?

  • Oh just one more thing, Who shall I post this letter to the DCA or the solicitor?
