need some advice about cb/tc repayment for single claim to joint

Hi, I am looking for some advice. I was claiming ctc and working tax credit as a single person as me and my partner had split up. We are now back together but didnt tell tc about the change in circumstances so i now have an overpayment, which i know was stupid but i am paying it back as it was my own fault. Now this overpayment is in my name but me and my partner are thinking about getting married next year. Will this "debt" of overpayment then become his debt too even though it was when i was claiming as a single person?

Also is child benefit and ctc linked? Im asking as i have a new baby, which my partner is the father of but not put in a claim for cb yet as i want to make sure that he isnt linked to this overpayment of ctc. Its so confusing and totally stressing over it all.

  • Hi i would strart claiming your child benifit now anyways... it really has nothing to do with your child tax credits, im having a major problem with my tax credit at the mo, i cancelled my claim as a couple and started claiming as a single but then i did inform them straight away we were back together and there still yet to pay me anything! its all really frustrating! i also have got an overpayment even though its as a couple its just in my name as i am the lead on everything... But are you aware that overpayment does not effect your credit rating at all.... it has nothing to do with actual debt as it was never money borrowed so it shouldnt make a difference to him anyway! hope that helps :o
  • Overpayments on tax credits are only ever linked to the the person or persons on that particular claim.

    If you had a single claim with an overpayment, you are the only person liable for this overpayment and it is in no way linked to your partner.

    If you had an overpayment on a joint claim, you would be both liable for the overpayment - even if the money was only paid to one person.
