Boiler destroyed! Not my fault. Who should pay?

  • That's correct losgiganteskid. I do not have contents insurance. But I do pay a third share for the buildings cover. I am advised that it is the buildings insurance that I should make the claim on, as boilers are fixed installations and not contents.

    If the freeholder doesnt want to claim then the freeholder pays it out of their pocket and its up to them if they want to take the other party to court (and probably lose as negligence is going to be hard to prove).

    The freeholder could be breaching terms of the lease if they dont provide working services.

    The amount is not very significant, shared across all the property occupiers (£100 each). But equally well, it's morally the fault of the other resident.

    I doubt that the freeholder is going to pay "out of their pocket". If it simply gets charged back to the three occupiers, that's not an ideal solution.

    Pressurise the guilty party to pay, and the job's a good'un.

    dunstonh - are you convinced that a buildings insurance policy would cover this in any case?

    Ok, so I'm still out of pocket, but I'm ok with that. At least I got that much and friendly relations can be resumed.

    Do you think I should ask the freeholder to make a contribution too?
  • I think you have got a result there Olympus (although you are "down" by an equal amount.) Importantly your relationship with your neighbour remains - so that has a "worth".

    Talking about worth - For what it's worth you could certainly ask the freeholder to make a contribution, on the basis that he has not made an insurance claim, so saving a possible hike in his premium and/or excess. Tell him he's a good chap, but would be even better if he crossed your palm with coins !! Well Done
