Anyone had dealings with Capital One

Hi my friend is having major money worries, she had been to CAB and they are helping her sort out what to do regarding her debts.
Now she is reciving calls from Capital one staff several times a day chasing for money, she has advised them the CAB are dealing with her affairs and that they will be hearing from them shortly.
She is finding them totally abusive to her calling her late into the evening approx 8.47pm (I have advised her of the 9pm cut off) and generally hounding her and for want of a better word threating her, has anyone else had any problems with Capital one? any advice I can pass on would be appreciated.
As I have said it's my friends debt I don't know the details of her debts I do know she is in very deep and could lose the house, I have told her about this site but at present is to upset to do anything about it, I am going to go and help her sort out items in the garage (stuff from a prev business venture) which is sellable and hopefully raise some cash for her this way.

Hi, yes, my mum had lots of trouble with Capital One - they just will not stop phoning (at all hours of the day of night).
See this thread: http://forums.moneysavingexpert.com/showthread.html?t=106846
I wrote a stinking letter to them stating that I thought the harrasment was illegal, especially after having been informed not to contact her directly (rather through the CCCS) and the phone calls have stopped.
I can give you a copy of the letter if you want, you can duly doctor it and send it off for your friend.
I'll have to post it from home (am at work at the moment), if you want it.
EDIT: Incidently, has she been charged by her bank for non-payment of DD's or standing orders etc... while this has been going on? This is a particular bug bear of mine, and I know how she can get those charges back if she has had any. I was in a bad financial position a couple of years ago, and was stung hard by these charges, making my situation worse.0 -
Thanks can you e-mail it?
Not sure about any dd charges I will when the time is right ask her
updated;
have looked at the link you posted thanks is this the letter you are refering to?0 -
Yes, will do. I'll send it from home tonight.0

I had trouble with these guys, lots of phone calls and they never seemed to ever take a conversation on board, instead the next day calling again and making my life like groundhog day. All letters were also ignored and the interest and charges carried on mounting up
Eventually through the advice of this board I wrote via recorded delivery to them and asked for all correspondance to be in writing and said that I would consider phone calls harassment. It was well worth the 66p for recorded delivery.
That seemed to work.0 -
So will they hold any interest?0

My OH at the moment is having problems with them they sometimes call 3 or 4 times each day. it does get very frustrating but I will advise him to send a letter like sportbeth did and then the calls may stop eh.0

Ask your friend to contact BT and see if she can get her number changed free of charge.
No one has the right to harass her like this and I'm appalled to learn she is being given abuse as well.
If there is any way she can get her calls screened? But I would go for getting the phone number changed. If she tells BT she is receiving nuisance and abusive calls on a regular basis they may be sympathetic.
(Not that I am advising you do the following but... a few years back I had a phone number that differed by one digit to that of a local restaurant. I got fed up taking bookings and BT changed it for me on that basis.)
If none of this is possible - all she has to do is hang up if they phone her and leave the phone off the hook. If she has a mobile number that they do not have - then she can ask friends/family to use that to contact her.
She should consider making a formal written complaint to Cap.One she needs to log the dates and times of the calls and ask to GET THE TAPES PULLED of the calls.
We all know that 'calls are monitored for training purposes....'
good luck0 -
If she has a BT line get Caller Display (free)
Then get anonymous caller reject (fee for this)if number 'witheld' wont get through!
Then if she wants some sleep get 'Choose to refuse' (fee also)
I have this and i am so tired of Phone calls , yes from Capital one!!!!
I have now barred them from ringing me!
And any other Creditor, they have all been informed not to call me but to post any thing they want to tell me, it gets passed on to CCCS who are dealing with all my debts!
It does not cost that much for the BT line to work like that........but worth the peace!!
Yeah I was getting calls at 8.57pm every night..........had enough!
Regards

They are calling all hours even when she is trying to bath her young son! when she tells them the CAB are dealing with it they are not having any of it, last week she cut them off and had to get the line released by BT as they have been leaving the phone connected.
Surely this is not legal
Thanks for all your reply's of advice I will pass them on to her0 -
The last time Capital one rang I press 14258 on my phone and ** to barr!
They have not got through since and it was 3 months ago!
Asked CCCS what to do about them, I wrote them a letter telling them no longer contact me through my phone, and this would be the last time I would be contacting them, also in the letters said you may contact me through Post, in turn these letters are delt by CCCS.
I am paying them back, I just dont know why they think I have extra cash?? I dont.
But the phone calls where getting beyond a joke!
So rang BT and they have sorted everything out, I have full control over who rings me.
Peace at last!
