Regardless of whether or not it's a legal requirement, I would say it's a wise step to take. Imagine how gutted you would be if you happened to get a judge who insisted on it.

For the sake of speaking to someone for an hour or so, and getting them to write you a letter it's better to be safe than sorry.

    Just spotted this!!

A judge has to make a professional judgment, as he is employed to do so, of all the facts laid out in front of him. If you have not taken professional advice then the judge can deem that you personally are not aware of the facts relating to BR, you therefore have a lack of information about the process and what it means, and he (she) can, if they want to, refuse a petition. And there is nothing you can do about it. There is no appeal - you simply have to reapply with further cost of fees.

Therefore you would be pretty stupid to gamble the £500 odd of fees against not taking free advice on the matter first. And it is just advice - you do not have to do what the debt charity tell you to do. But you need to have sufficient information before you can make a decision. And the judge needs to have all the information before he can make a decision.

I would hate for any newbies reading this post to think its just something they can think is "okay" for them, and off they go.

Thanks for that information on advice as that is now what I have to get sorted out, I will begin my own thread I was here back in June but things got shelved as I will explain.

I would also agree better to take the advice than lose the money when refused by the judge, that would be heartbreaking having had to save it up.
