off sick do i need to inform tax credits.

I started work in march after being on incapacity benefit for many years.
in june i found out i was pregnant and informed my employer.
i am now off sick due to the pregnancy, my employer will not be paying sick pay as i had a 104 week letter from the job centre that said if i go sick with 104 weeks of starting work i have to claim incapacity benefit again...

job centre have confirmed i will be getting incapacity benefit, so do i need to inform tax credits ??
i presume i will go back onto the higher / long rate benefit again, which is taxable.
the job centre said it will not matter as we dont get working tax only child tax credits, but when i fill in my annual review next year i will have to put taxable benefits and surely tax credits will want to know why i did not inform them before...

any help much appreciated...

  • As long as your sick leave is less than 28 weeks you wont need to end your working details with Tax Credits.
    You will however need to declare the amount you receive from IB as it is a taxable social security benefit.

    so if i am sick for more than 28 weeks, will tax credits then class me as not working ??

    i have to ring them to alter my childcare details so i just tell them i am off work sick and claimming incapacity benefit as i cant get sick pay through work ?

    I have just read your initial post again. If you are on short term IB you dont need to end your work details. If you receive the long term higher rate you will need to inform TCO as you are not classed as being in remunerative employment.

    You will be receiving a higher entitlement of IB so would not qualify for WTC.

    I am not sure about claiming maternity allowance or IB.

    Someone else will know more about DWP/JCP benefits than me.

    i only get child tax credits we earn to much for working tax credits, so the job centre said i dont need to inform them as it makes no difference to my amounts...
  • But even if you don't actually get any WTC because your income is too high, having the WTC in the calculation can make a difference to your CTC amount.

    You must therefore inform the TCO, especially if it is long term IB you go back onto as you will not longer be in remunerative work.

    Does your partner work? If he works enough hours, the WTC will remain in the calculation.

    Have you checked the position for the childcare element if you claim it?

    i do claim childcare costs, and yes we both work full time...
    so will it efect my child tax amounts ??

    i m not leaving work and i am hoping to go back in the next few weeks, so why will they class me as not working, i am just off sick !!!
