Advice needed Capital one

Hi my friend is having major money worries, she had been to CAB and they are helping her sort out what to do regarding her debts.

Now she is reciving calls from Capital one staff several times a day chasing for money, she has advised them the CAB are dealing with her affairs and that they will be hearing from them shortly.

She is finding them totally abusive to her calling her late into the evening approx 8.47pm (I have advised her of the 9pm cut off) and generally hounding her and for want of a better word threating her, has anyone else had any problems with Capital one? any advice I can pass on would be appreciated.

As I have said it's my friends debt I don't know the details of her debts I do know she is in very deep and could lose the house, I have told her about this site but at present is to upset to do anything about it, I am going to go and help her sort out items in the garage (stuff from a prev business venture) which is sellable and hopefully raise some cash for her this way.

    Make sure she keeps detailed records of the calls. If possible ask for a name or some form of ID from them then state that the matter is being dealt with and Capital One have been informed. She could start her side of the conversation by stating that she intends to record the call, whether she does or not it can often result in a change of attitude.

    If they have not already been informed make sure they have been, inform them in writing of any steps that are being taken.
    Although she does not have to put up with abuse it is essential that the lenders are kept informed of any actions being taken and they have to be told if there are any breaches of terms and conditions being made or they will simply add penalties to the debts. The CAB will know this and should be able to make sure that appropriate correspondence is sent.

    When Capital One are fully appraised of the situation she should write (not phone) and complain about the treatment she is being subjected to including all specific details that she can. I would not hold back in condemning their actions and would ask for confirmation that action will be taken against whoever condoned this behaviour.

    There is a "debt free wannabe" board on this site and a dealing with debt board on the Motley Fool which might be able to offer more help on the debts rather than specifics about credit card lenders.

    She is perfectly within her rights to tell them not to phone anymore and she will only deal with them via letter. That way she can keep an accurate record.
