    31.7.35 Satellite TV and broadband internet contracts

    Ongoing contracts for the supply of goods and services which remain extant at the date of bankruptcy vest in the trustee of the bankruptcy estate. Where the bankrupt is still in receipt of ongoing services under contract at the date of bankruptcy, notice should be given by the official receiver/trustee to the service provider stating that he/she does not wish to adopt the contract and services provided under the contract should cease. This includes contracts for satellite TV or broadband internet connection,where the bankrupt has signed up to the agreement for a set period which cannot be terminated without a penalty being incurred. Any penalty for early cancellation should be included as a debt in the bankruptcy proceedings.

    NB: With the advent of combined telephone and internet packages available via broadband (where telephone services are provided free or at a reduced rate as a result of the broadband service provision), the official receiver should consider whether the expenditure claimed for these combined services may in fact be equal to or less than the cost of a traditional land line only telephone service, which would be considered a reasonable domestic need. However, the need to notify the service provider regarding non-adoption of the contract must still be taken in to account by the official receiver/trustee.



    But if your not working and on benefits your not paying for it so why is it going on your I&E:confused:Is it in your name? if so just transfer it to your OH before yur BR date

    Sorry but if your on benefits or no income the cost of sky is erelevant as the OR wont be able to impose an IPA so fail to see what the problem is apart from the OR ceasing the contract, and that, in theory, is easy to get round

  • You wouldn't die without it very few things are essential TV in any form isn't one of them. I havn't had sky for over a decade, when we moved we didn't bother putting the dish back up. Didn't miss it then, don't miss it now.

    If you already have sky, and your contract has ended you can get a freeview card for £20 anyway,and no monthly fee, bit of info for those who are in a bad reception area;)

  • I would make sure that any contracted service is not in the BR name & switch it if it is. If the contract is in your OH name & she is paying then it cannot affect you.

    Just like to say I have no TV either or Sky (do have very nice flat screen TV that has not been on for last 4 months!!) Not missed it as have broadband as part of BT & find much cheaper...use iplayer & catch-ups online!

    When people say not to put internet & Sky on your SOA, it's because the OR will see these as luxuries. The only exceptions to that that I can recall are (a) if your internet use is part of a programme of study, or (b) you do some work from home. In both cases, your employer would be expected to pay all/part of it, with you covering the rest from your surplus because the OR won't usually allow you money for these items. Although you might think they're essential, they're not really no matter how much you feel you need them :) - some people who live in major towns do without a television period, so they never get involved in the Sky/Freeview/"can't get a decent signal" debate: they read, make use of the free activities offered by the local authority, listen to music, do sports etc. Many people also don't have a home computer - they make use of the internet at work, use library facilities or go to an internet cafe a couple of times a week. The same applies to mobile phones - some people have kept their contract mobiles by doing without something else, some have gone to PAYG services & some have got rid of them altogether. Cigarettes are another area the OR isn't going to give you an allowance for. :)

    I can understand that if you've got used to having something, it's a real wrench to have to make do without it, but when you're facing going BR these decisions do have to be made. If you can afford the cost from your surplus or if someone else is paying for it, then there's no real reason why you can't keep them. You do have to prioritise though, & ask yourself if the money could be better spent on other things. I still have my internet, but only because I cut back in other areas to have it & other things I feel I need. :)

    But the issue I have is no income or benefits so how can i do a SOA as we have cut back on so much on my wifes wages with things like shopping, clothes, mortgage now interest free and going out has stopped.
    Funny someone mentioned sports but where I live they all cost plus travel so unless you live in a big city more cost

    In the area we live there is no analogue or freeview signal. When we moved here I looked on the freeview website, which informed me that I could look forward to it being rolled out here in 2012. :rotfl:
    So for us sky is essential, well as essential as having a tv license I suppose, :confused:

    According to the Freeview website my area won't be 'on line,' until 2011 but I can get a signal but only in the winter for some reason. In the summer it's just coloured lines. I use Sky in the summer when I only have free to air, greatly reduced number of programmes and Freeview in the winter!

    You have to do a I&E anyway - its manadatory. It would look along the lines of ZERO for your income and £xxx for your wifes contribution. List the essentials that she pays for only - housekeeping/rent/council tax/tv licence/utilities/insurance etc and ensure that this amount and her contribution more or less match. Having no income at all will mean that you will not get an IPA, but this is still a process you have to go through.

    Firstly: a) maybe you should look into getting what you're entitled to in terms of benefits. This, at the very least would surely have a positive impact on your life in terms of slightly more income and would give you access to discounted use of your council sports facilities. It would also give you discounted travel - surely a bonus.

    b) I live in London. I do not have Sky or Cable. I also do not have internet at home. I used to think these were essentials but since BR have got used to not having them. I go down to my local library and use the internet facilities there for free. It can be a pain in the **se but I can't afford it as it is.

    c) You need to do an I&E. I can understand this might seem pointless to you but the O.R. needs to audit your current financial situation. There have been a number of posters on here who have had no/limited income but have still had to provide an account for how they live their lives. Bear in mind that while you are an undischarged BR, the OR *OWNS* you and will make you jump through a variety of hoops for his/her pleasure. And all you can do is jump when they tell you to.
