What will happen next?

My BIL has gone to court today about his house being repossessed, he is staying with me & has been since June when he found out that his wife, my SIL was £3000 in arrears with the mortgage. He asked to stay for 2 weeks & we are now into the 4th month.
How long is it likely to be between the first hearing & the actual eviction?
SIL is convinced the council will rehouse her because she has a 10 year old, I'm not convinced?
Can the court force me to take her in, I do have a spare room, but not sure I can face her & BIL screaming at each other all the time, she also has 5 cats & 3 dogs. I feel mean, but I'm finding it hard enough to cope with taking care of BIL, who is depressed & turning to drink.
Sorry to whinge, but I don't know who else to ask.

    They cant make you take her in.
    Try to convince brother not to let it get repossed,much better to sell it yourselves, why is she not paying the mortgage? If you brother is on the mortgage then this will cause him problems as well, can he help towards the mortgage, any equity will be split betweeen them when they sell.
    As for expecting the council to house her, they may but if she has equity then that may go against her. Silly attitude.

  • Thanks for that PP, I can stop panicking now.
    BIL wants to sell but is unwilling to accept reasonable offers, there is no equity in the house as they have remortgaged many times, always to pay off SIL's debts. I'm not really sure why she didn't pay the mortgage, BIL was giving her £450 a week, she spent the money on carp & nights out.

    tell him to get himself down the citizens advice centre and start doing somethink to get his life back on track otherwise you are going to end up as his landlord..and you cant be forced to house her at all...good luck and well done for helping him but he needs to move on..

    Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
    If you are planning to upsize the new house will cost more.
    If you are planning to downsize your new house will cost more than it should
    If you are trying to buy your first house its almost impossible.

    I'm not convinced either !

    She may be in a priority needs group. The council should investigate is she approaches them, but they may find she is intentionally homeless if she has either done something that has resulted in her homlessness (ie not pay mortgage whan she could have done) or she has not acted in a way to prevent her homlessness (ie not attempted to make or keep to an agreement with the lender)

    Even if accepted as homeless, the solution from the council may be a move into a private rent rather than the keys to a council house.

    I know your loyalty is with your BIL - but please also encourage your SIL to seek help now rather than wating until the last minute.
  • Thanks squinty, I have tries to persuade both of them, but unfortunately BIL would rather bury his head in a can of lager & SIL just assumes she'll get a free house, I've tried explaining, but they all think I'm stupid for living such a frugal life, so take no notice.

    Just to let everyone know what happened when BIL went to court.
    They were given a 2 month extension to give them chance to sell the house after the redemption charge has been lifted, they won't be able to sell on the open market, the house is messy & smelly, 5 cats & 3 dogs. That's not my opinion, it's the Estate Agents feed back. They should be able to sell the house to an investor & come out broke but with no outstanding mortgage debt, just the other £12k debts. Thanks for all your advice.
