Some advice please!

I think I am going to be going bankrupt.

I thought that maybe I should do a few thigns to get reay fro it.
1. I am still using my maiden name and married name, debts in both different names. We got married abroad and the reason I havent changed my name everywhere is that my marriage certificate is in spanish and I need to get it translated. Would it be right or wrong to pay #80 translation fee on my credit card and then make sure everything is in my married name?

2. In June H and I moved to Devon from Bristol. I changed the address on everthing then. Then we have had some troubles and I am currently living at my parents in the week and Devon at the weekend. To make things easier amnd I suppose in haste I changed my address to my parents house in Bristol. We have now decided we are going to make a go of our marriage and Im going to move back here and try again. Shall I get erverything changed back to this address?

3. SOmeone was saying the other day that you have to be in you current address for 6 onths or you pettition in the area you have lived for most of the revious 6 months. Would this be devon or Bristol? Im confused!!

5. Also, h has an interview tomorrow, he is on JSA at the mo. If he gets the job he will be earning around #800 per month. I owe soely in my name #30,000 and with paying all the bills at the mo have adeficit of #650. When he si earning, his #80 will cover the deficit if we put all our money together but then ill sstill have it hanging over me for years as in reality I dont think well ever pay it off. Also, we'd like to have a family in the future but cant with this over us. Would you still recommend I do the bankruptcy? We rent so dont have ahouse to worry about and we are 28 and 23.
I suppose what Im saying is Im worried the judge will say you can just about cover it so no.

P.S Ive got an interview with CCCS booked for 15th Sept so by then we'll know if H has the job, and if your situation is different.

    also, just realised that when I moved to my paretns I told the council I havd moved out and they sent a final bill up to that date in July. I havent paid this yet and also my H hasnt paid anything. Can I put this onto my cc to get up to date? God this is a mess.

    Will be interested to see what replies you get because we may have to go down the bankruptcy route. We have a huge deficit each month but own our own home, so have been advices by citizens advice to stop paying secured things (Mortgage - secured loan) and let it be repossessed. Theres almost definitely going to be a big shortfall and when we're hit with the request for that - bankruptcy will be looming.

    God this is a mess, inside im also so so worried about what my aprents will say. They hate my h for not having a job and will think its all his fault :-(

    I know, its so silly. Im 28 years old and still worried what theyll think, im just going to have to tell them straight and hope they inderstand.

    Its just I think they feel I should have left h by now and its his fault that im having to do this. But even if we didnt make it, i couldnt manage to rent on my own and pay all bills and debts

  • So, he didnt get the job, they said he would have trouble getting there in the mornings on public transport, argh!

    I think i secretly hoped hed ge thte job and that maybe we could struggle on without bankruptcy. Im not sure what to do now, feel so rubbish at the moment.

    im so wirried what my parents think and also if I do this while living in Devon that we wont ever be able to move :-(
  • Hi, i know what you mean abouy telling your parents. Me & OH have decided to both go BR, we have sorted out a house to rent which we are hoping to move into this weekend, then have our house repossed. Im still tring to get up the courage to tell my parents as they are funny about things like that. They dont understand how people can get into situations like this, go BR then carry on as normal. I was thinking today that i will write them a letter & post it to them, then wait for the blowout. I cant tell them face to face as i know they will be so mad at me. Im 32 by the way!!!!

  • Redfraggle, its rediculous isnt it! I just know they will be dissapointed and blame it on my h when actually he hasnt had access to our money for ages because of a gambling problem, it was me spending on them. Its just got out of hand now and what with him not working im really struggling. but this could be anew start for us and I want to take it while I dont have much to loose, ie no house.

    Good luck, its rubbish isnt it. Im just finding it scary how it can all happen so quickly if I wanted it to!
  • i would just try and not get worked up, because from the sound of it your getting all stressed and crazed bout it(which is normal i did exact same) but you dont wana make yourself ill with it.

    so take a deep breath.

    I'd just try and relax till youve spoke to cccs, in meantime just pay your creditors a £1 a month, i would speak to the council bout the tax tho because you can get in big trouble, but i found that if they just hear from you it does a lot of good, just explain to them that your having trouble ect,
    DON'T TELL THEM THAT YOUR THINKING BOUT GOING BANKRUPT.

    If the CCCS tell you that they think your best option is to go bankrupt then it would be very unlikly that the judge would say no,
