doorstep debt recovery

my dh and i are just setting up a dmp with cccs, one of our creditors is moorcroft, who collect from us monthly at our house, once the dmp is running will they stop calling, i hate people coming to my house like this, its embarrassing also I have written to all my ceditors telling them whats happening and to stop calling me a dozen times a day but they will not back off, currently we are only one payment late and havnt been before, only due to a huge drop in income we are going down the dmp route, im concerned that they will phone even more once im more than one payment late

anyone got any advice?

    I'm not if the moorcroft people will still come to your door. Regarding the endless phone calls, I'm sure I've read on here somewhere that you can write to each creditor and ask for them to contact you only in writing, and I'm sure it said something to do with the data protection act, you have the right to ask them to stop calling you. I'll see if I can find the info and will get back to you.

    Moorcroft are parasite's,bullies.
    They don't have any power,if you go onto the www.consumeractiongroup.co.uk/forum/
    you will find plenty of helpful advice rearding moorcroft and other dsc as well as this site.
    Always commuicate via letter and keep a record.
    If debt is credit card or some kind of credit agreement write to them requesting a CCA, send recorded delivery,do not sign letter,they have to reply in 12 days.If they don't then after 30days the debt could be unforceable.
  • the original debt was from british gas, electric and gas accts, ombudsman has dealt with this (long story) but now i have a full and final bill, one is being collected from moorcroft at £10 4 weekly and westcot want £32 every 4 weeks - both on my doorstep!!!

    i have written to them to let them know i am arranging a dmp and cccs will write to them as well once its set up completely but can they still keep coming round every month as well as cccs giving them money??? i told one of the collectors and he said he will still call!!!

    The collectors have no power,they send harrasement letters,phone.Do not be frightened by them,if you are being harrassed by them there are ways to stop it.The collector will soon stop if he doesn't get any money.Make sure you are not being charged for each call.
    If debt is small they will give up. Applying for a CCA is no good in this situation.

    If they continue to call once CCCS are paying, then tell the collector to BU**ER OFF. :D

    If they won't accept it and won't leave, then call the police and get them removed. :)

    There is no reason why you should accept them still calling.

  • thanx, i was hoping i could do that, i just read on cccs website that creditors dont have to accept us going on a dmp and can still try and recoup the money owed, thats why i got concerned

    Creditors don't have to accept a DMP, but you also don't have to accept doorstep calls.

    A majority of creditors will accept a DMP eventually, sometimes after making a bit of a fuss and claiming they won't. If they don't then they could go to court, but the most likely result of that is you being ordered to pay something rougly in line with the DMP payment.;)

  • so if some dont accept a dmp they can continue to write to me and take their own steps??

    would the court look favourably on us though as we are taking steps to sort the mess out and not ignoring it, or would they swing more in the creditors favour?

    Believe me, most judges really hate DCAs like Moorcroft. ;)

    If they see that you are on a DMP with CCCS, they will normally look at you more favourably than the creditor.

    If they should take legal action, which in all honesty is unlikely, then CCCS should help you with that. It seems scary, but once you realise that they are fairly powerless then it gets better.

    It might be a good idea to join the DMP mutual support thread here, where there are plenty of people in a similar circumstance.
