getting a purchase refund on a credit card for faulty goods

Can anyone please give me some advice....I recently purchased a bridesmaids dress from a wedding dress shop for my brothers wedding and paid for it using my credit card (tesco mastercard). The shop required payment upfront before they would order the dress and then you go for fittings. Once the dress was ready my Siter-in-law tobe pick the dress up for me and when we got it home we found 2 holes in the fabric, and 4 other marks on the dress that looked like stains or faults in the fabric made when it was dyed, also the dress had been taken out to fit me so much that there was very little seam down the side and it was all coming apart. I obviously returned to the shop and complained and they said there was nothing they could do as we only had 2 weeks before the wedding and a replacment dress would not arrive in time, therefore I demanded a full refund. After 45 minutes of debate the shop manager wrote me a business cheque which after banking has failed to clear twice. I am going back to get the refund put on my mastercard but I was wondering if I have any problems will mastercard help me in anyway get my money back as the shop now have the dress and my £180! If mastercard wont help what else can I do?

  • The fact that you have a cheque from them proves that they owe you the money. If you sued on this you would win - small claims.
However if the business is in trouble you might win but not get anything so Yes I would be pressing your credit card for a refund.
