Can I complain?

I brought a computer chair late last year (Dec time) and today the top has broken off, can I make a complaint as I thought you're allowed to do this up until 12 months?

Any advice would be great

  • I think the chair cost about £50 new but we dont have the money to replace it ourselves, I also have a similar problem with my bike waterproofs, whre the lining as come apart at the seams after 6 months, the gloves the same and the boots constantly letting water in even thought they are meant to be water proof. They cost well over £200

    Just to be safe, are you in Scotland? The following is for England and Wales, Scotland/N.I. may be slightly different.

    You can make a complaint against your retailer NOT manufacturer. You can complain that the goods do not conform to contract namely, satisfactory quality, fitness for purpose and durability.

    Sale of Goods Act 1979 as ammended by Sale and Supply of Goods Act 1994

    Section 14
    (2) Where the seller sells goods in the course of a business, there is an implied term that the goods supplied under the contract are of satisfactory quality.

    (2A) For the purposes of this Act, goods are of satisfactory quality if they meet the standard that a reasonable person would regard as satisfactory, taking account of any description of the goods, the price (if relevant) and all the other relevant circumstances.

    (2B) For the purposes of this Act, the quality of goods includes their state and condition and the following (among others) are in appropriate cases aspects of the quality of goods

    (a) fitness for all the purposes for which goods of the kind in question are commonly supplied,

    (b) appearance and finish,

    (c) freedom from minor defects,

    (d) safety, and

    (e) durability.


    So, if you think the chair and the waterproof things should have lasted longer than they have, and you have treated them well. Then you can complain. The retailer is likely to refuse your complaint initially, then you have have to write a letter, and if still no joy, you have to decide if you wish to make a small claim action against them. It will be up to the court to decide who is correct (you or the retailer), if they decide it is you, you will be entitled to a repair or replacement, or refund after deductions taking into account the use you got from the goods for 6 months.
