A few months ago had a dispute over payment, and Paypal took just over £200 out of my account, I was in negative balance but I refused to pay it because they had ruled in buyers favour (who had reversed charges on their credit card) and I had lost £200 of merchandise.
Now this morning I've received a letter from Debt collectors demanding the money.
I am happy to take this to court because I am sure what Paypal have done is illegal.
Can anyone give me any advice on what steps to take? Or what's going to happen now? Has an issue like this ever actually gone as far as court?

In simple terms, if the payment you received came from an unverified member and/or it was not sent by recorded or special delivery, then according to the T&C's of the Paypal Seller Protection policy, you were not covered and sent the goods at your own risk. Therefore when the credit card cmpany took the money back from paypal, they were entitled to recover the funds from your account.
However, we don't know the specific details of the transaction, so a court, if it got that far, may see it differently. I've been lucky enough not to have this happen to me, so I can't give any help on dealing with the debt collection agency, although if you search this form for the company name (Interim Justita or suchlike?), I know there are previous threads on the matter.<--- Nothing to see here - move along --->0 -
Hey, i had exactly the same problem but for the amount of 40 quid. Got a debt collector letter a while later.
I rang Paypal and they said it was my fault but would make contact with the seller on my behalf. I later got an apology e-mail and my balance returned to 0. I spoke to Ctizens advice during this time and although on paper you are in the wrong i was told it would never stand in court.

I have never heard of PayPal taking anyone to court, nor have I heard of these debt collectors actually calling in person at someone's house.
I would imagine PayPal have too much to lose by taking someone to court. Imagine if the court found against them.0 -
Thanks for putting my mind at rest. I was expecting them to show up at my door demanding money! This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0

You will probably find the 'debt collectors' are actually a subsiduary company of Paypal themselves.0

Actually one lot of debt collectorss used by paypal had an official warning about 18 months ago for their unpleasant customer 'service' tactics including intimidation and breaching data protection by making comments to neighbours etc.
However, I think ebay/paypal now use Intrim Justica (is that correct?) and they seem to stick mainly to letters and phone calls. However they do occasionally visit as some of the horror stories you get when you Google the situation suggests.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards.
