No not really the same. In Bankruptcy if gambling has occured after 01/04/2004 and has significantly contributed to the insolvency (ie 5K loss of £20K debts or accounts for at least 20% of debts) then the Official Receiver may report matters to the court and seek a Bankruptcy restrictions Order. The court decides whether to give a BRO, period is 3-15 years. If granted the BRO means the restrictions and duties of bankruptcy remain for as long as BRO: ie Trustee can claim property acquired afer the bankruptcy, cannot obtaine credit over £500 without disclosing BRO, cannot be inclolved in managemet of ltd company etc.
But the OR or creditors cannot 'pursue' the bankrupt for more money back just because of gambling.... the Trustee must realise all ssets in the bankruptcy irrespetive of what has caused the bankruptcy...moneysavingplumber wrote:It's similar, as far as I know, in bankruptcy, whereby if a creditor argues that you are in debt because of 'reckless' spending they may be able to pursue you much further than if you were the victim of 'circumstance' as such.0 -
