Broken table - do i have any rights to a new one

Looking for some advice if possible. Basically we bought a dining table and chairs about a year and a half ago. Just before it was a year old we noticed it had a crack going right down the middle (as we had a table runner down it i dont know how long it had been there). Anyway, we went back and complained to the shop who said they had changed owners and nothing they could do. Well we were in the same shopping centre on saturday and noticed that the shop is still called the same name (this is 6 months later) so again we went and spoke to the manager who said it had changed ownership just not name. So we said we would like to get complaint taken further as if they are trading under same name I still see them as same company. Whilst there another member of staff said that this table had been returned by other people in the past for the same reason (splitting down the middle). So the manager said she would speak to her boss and call me back. Well she just called me back and said there is nothing they can do as not same company. Can they do this or do I have any rights?

Are they the same company or is it a company using the same trading name?

If it is the same company but different shareholders then your rights against the company are the same.

Have to say, I'm not too sure you would have the right to a replacement at this stage in any event.
  • its a different company which has taken over the original company but is still using the same name.
  • its a different company which has taken over the original company but is still using the same name.

Then you would be unable to ask for a refund or exchange directly, not sure about CC avenue if you paid on CC? It seems a little late, but I would expect a well built table to last alot longer than 1 1/2 years even with excessive use!

I'm sure someone will be along soon who knows where you stand legally.
