Decided to go bankrupt, really scared!

    So they've back tracked on the IVA and now suggested bankruptcy as an option.

    That makes a lot more sense.

    If you take the DMP route, don't forget to post on here when you've completed it in 2063!

  • Just a quick question, if you have ccj's on your credit file, are they wiped out with bankrupcty?
    Only asking as ive received a letter from the court saying i have 14 days to pay £130 or i will get a ccj. I dont have £130 so not sure what ishould do.

    Just a quick question, if you have ccj's on your credit file, are they wiped out with bankrupcty?

    With very few exceptions (notably most, but not all, Student Loans) EVERY ONE of your UK debts will be written off by your bankruptcy.

    Therefore, if you have an impending CCJ, or even outstanding 'defaults' don't worry - certainly, once you have definitely decided on bankruptcy, don't make any further payments towards them, or, for that matter, any other creditors, with the exception of your utilities, rent/mortgage and council tax.

    Instead, use the money to pay for your Court fees.

  • We owe money to E-on for gas & electric & united utilities for water. We are paying off the arrears but would we be able to include them in the bankruptcy aswell?

    Generally, yes, but you may need to seek clarification, particularily on the 'water-rates' as some utilities 'arrears' for the current year may not be included.

  • Ive been reading other peoples and different people have opened new co op bank accounts at different times. some opened before br & some days after. This is something else that is bothering me as OH gets paid weekly. If we wait till after br & it takes a few weeks to get sorted, where will his wages go? If they go into old account we cant have them. If we open new account before br, will it be frozen aswell? Im stuck!! what do i do?

    You can open a Co-op Cashminder now and mark it on your forms as the one you opened for bankruptcy. You also point this out to the OR when you talk to him when you go bankrupt. I have only known 2 accounts to be frozen with the Co-op and I have been lurking here for nearly 2 years. If it is frozen then a quick phonecall to the OR usually sorts matters.

  • Thursday 28th:
    Well i couldn't sleep properly last night.
    Spoke to OH some more & hopefully we are going to view a house this evening. The rent is a bit more than the mortgage but with not paying other debt's we can afford it. Our mortgage payments will be going up in December anyway & Capstone wont tell us how much!!
    The house is literally 5 mins from the 3 schools that the kids go to, were as at the min we have to walk for 40 mins to get there.
    Ive decided not to pay the mortgage on 1st & cancel all other dd, except for utilities. That said my electric went off last night as my meter had run out of money!!!
    Capstone have tried to reposses twie in the last 12 months so i went through old paper work to see how long we have got from missed payment till court proceeding & we'll have 4 weeks!!!
    Hopefully we will have enough money for deposit & 1 week rent plus br money.
    The ll on the house we are looking at said we can pay weekly, which will be better for us as OH is paid weekly.
