Car passed MOT but developed problem in centre

My car has just passed MOT, great news BUT as soon as I left the centre and drove the 1 mile home the front wheel was making a awful grinding noise when turning. So I took it back round to them and they told me that 'these things happen'!
He advised that it was the wheel bearing and that I should take it to a mechanic to get fixed! The car was fine when I took it in and had a full service and new rear suspension last week.

Now, I have to go back tomorrow to see manager but was hoping anyone could help me with - Would the car have passed MOT if the wheel bearing was like that beforethe test.
He did tell me that it prob happened when up on the ramp as the wheel was lowered IYKWIM but is this correct?

Am really cross, car was fine when it went in, passed MOT and got it back worse!

I live in NI if it makes a difference to MOT rules.

    Maybe they do happen but was it their fault if the fault wasnt there before?

    When checking the bearings the MOT testers do tend to have a bit of a go at them (but then again on the road they can be subjected to quite extreme conditions). I don't know if it's possible that that sent it off. A car would not pass an MOT with a rough or mal-adjusted wheel bearing - so if it was in the condition it seems it is now it would not have passed the MOT. Shouldn't cost any more than £100 to sort.

    How are you intending to prove that they caused the failure. Your best chance is that the manager offers some compensation on a goodwill basis. His attitude is very likely to be guided by yours so approach carefully.

    The company testing the vehicle is not liable for any damage that occurs as part of or result of a procedure carried out during an MOT test and that is explained in the literature available. The MOT test is designed to test components are working correctly and to stress them beyond normal everyday use in some cases such as the brake test.

    If MOT testing stations were to have any liability, you'd not find a single garage willing to carry out MOTs.

    True.

    As said Fri night - we had a fan belt break during emissions test ( thank god not the cam belt). We replaced it - customer charged (he was happy - and said glad it not happened to him whilst on motorway etc) .

    It never ceases to amaze me the amount of people that find faults after an MOT - even tho the problems they find, are not even touched during the procedure.

    And they have the nerve to criticise the garage.. :eek:
