Neighbour Issue - TV Aerial

I was just wondering whether you guys on the forum could help me! I live in a housing estate although i own my house my neighbour doesnt and is renting it from the council, and i received a letter from them saying that if i do not remove my aerial then they will remove it as it is within their rights, my aerial is attached to my house and is nowhere near touching theres and is facing over their house but there is quite a big gap between their roof and mine. If any of you could help me and tell me whether this is legal or not? And whether if he removes it it will be criminal damage. And whether there are any websites/policies/laws to back it up. I had this aerial fitted back in 1997 by a company so i'm sure they wouldve said if it was legal or not but from where i see i it is legal, it isnt touching their property, and is attached securely to mine, which is in total contrast to there aerial but thats a totally different rant! I've emailed the council about it and i am awaiting a reply. I have enclosed some pictures below, sorry if its in the wrong section i didnt know where to post.

Both the aerials look like they're more or less the same height to me.. I don't see what the problem is here.. Are they worried about getting bad reception or something? What's the difference to them if your aerial is there too? It is attached to YOUR wall, so I doubt there is much they can do...0

It is not about bad reception, they are trying to find fault with our house as we had complained to the council about them parking a caravan in the parking bay infront of our house. Thats what i was thinking and was thinking if they do remove it then i will have to get the police involved.0 -
Is the parking bay yours? If it is a public parking bay, then I don't think you're allowed to park caravans there anyway, and if it's your private drive, then definitely not...
I sympathies with you.. Why do some people seem to think that breaking the law is their right, and when they get 'grassed up', they take it out on the person who is upholding the law? It's ridiculous.
I don't know if it is legal for him to remove your aerial if it is over their property or not, but I hope it isn't, and I hope they break it, and I hope you get them fined for criminal damage and they have to buy you a new one!0 -
Its a public parking bay and they aren't allowed, the council say they are dealing with it. Well they said that thy have given us 14 days to remove it, so we will just have to wait and see what the council say.0

Why don't you just e-mail these pictures to the council and ask them to detail what they expect you to do and I would also mention the posibility of damage caused to your roof by the poor location of the neighbours Ariel .
Surely it is time you contacted someone at the council and start recording these contacts .E-mails are good for this .
Looks like you have an Ar##hole living next door and may need all the ammunition you can to come away smelling of roses.0 -

I have contacted the council, and the local housing officer but i have had no reply to this matter! I find emails are better because you can have a record and send the pictures (these are the same pictures i sent to the councilhence why they have the writing), thanks for your input so far. I will also email the local councillors aswell.0 -

- You are, because the aerial is infringing on the neighbouring property and unless you have written permission from the freeholder next door, then you may have to take it down.
- The neighbour is for threatening to take your aerial down. He should go thrugh the freeholder AFAICS, unless yours went up after he arrived. [It went up before, of course, but think what happens if you need a replacement or repairs].
- The neighbour is for his aerial hitting your roof.
After the uprising of the 17th June The Secretary of the Writers Union
Had leaflets distributed in the Stalinallee Stating that the people
Had forfeited the confidence of the government And could win it back only
By redoubled efforts. Would it not be easier In that case for the government
To dissolve the people
And elect another?0 -
I would suggest that both aerials are in fact tresspassing on each others' property.0

Everyone is on dodgy ground here.

I read it as the council has been informed by someone (probably the tenant) of this Ariel .The council has then contacted the OP ,who is the freeholder .
Maybe the OP would rephrase the part about who contacted them with the removal request ?0 -
The council never contacted me about the aerial the tenant of the council house did and can anyone tell me what i could do if they remove the aerial withoutgoing through the appropriate channels?0
