I wonder if you can help or give advice on behalf of a friend.
Someone I know, who is from Bulgaria has been working in the UK for the last 2 years, (permanent employment) they recently changed over to contract via an employment Agency.
The problem is that they do not have a work visa so the Agency will now not employ them.
Are there any options to resolve this problem, ie.
1. Go through another agency and contract via a limited company.
2.If they apply for a work visa now (2 years later) what will be the implications, do they risk being deported.
Although Bulgaria is part of the EU, apparently there is an E8 Form that needs to be completed when a person starts working in the UK, but this person was not aware of that as the last company hired him without this.
Any help much appreciated.

It's possible that the Bulgarian national may have previously been given "self-employed" status and therefore needed no permission to work.
If the person you know is not now classed as self-employed, there is a limit on Bulgarians working in the UK, except for farm work for example, so there may be no permissions to work left as there is a yearly limit for Bulgarians.
Bulgarians have a right to "visit" the UK freely so unless he or she has committed a crime and has served a long sentence or is seen as a threat to the security of the UK, he or she will not be asked to leave the UK. The agency will be prosecuted though if it employs a Bulgarian who does not have permission to work, if it is needed.0 -

You say they have been working here for 2 years - does that mean they started before January 2007? If so they would have needed a visa as that was before Bulgaria joined the EU - and this means they are exempt from having to register (they just need to show they had a valid visa in January 07 and that makes things OK).
I'm afraid I don't know much about what to do otherwise, but it looks like there is a lot of good stuff on that website.0 -

I am not really sure when this person came to the UK ie. if it was before or after January 07. The company he was employed by then must not have asked for any form of work permit either.
