    Your hand was being used to hold the phone and not control the car, which is the offence of driving without due care and attention.

  • What if the hand was being used for nose picking/ear cleaning?:rotfl: Seen plenty of guys doing that behind the wheel - is that 3 penalty points and a 60 quid fine too?

    I received 3 penalty points and a £60 fine, I had my mobile phone in my hand and it was ringing, I looked at it but did not answer.
    Does anybody know the laws about this?
    Technically, if the phone was merely ringing and you did not answer it then you cannot be fined for using it.

    But you may be able to be fined for looking at it and therefore not driving with due care and attention.

    Was your fine for using the mobile or was it for driving without due care and attention?

    Yes, technically it is the same offence.

    It really annoys me that so many people are still flouting the law by using handheld mobile phones when driving. It is still a very common sight in my area of Surrey, and 'white-van-man' seems to be the most common culprit.

    It makes my blood run cold when I see some plonker trying to steer a heavily loaded vehicle turning left or right at a busy junction, with just one hand on the wheel and what little passes for a brain focussed on the phone call and not the road.

    Do you really think it will cease?

    How long have we had speeding laws, and people still speed with the same penalty, £60 and 3 points,(can be more, but that is the fixed penalty, as is the mobile phone one).
    Don`t steal - the Government doesn`t like the competition

    That's because our elected representatives have got it wrong, and passed bad law.

    On any given motorway on any given day, I would suggest that 2/3 of car drivers are travelling above 70 mph. If you have a law that most people are breaking regularly, then that is bad law, and the government "of the people, by the people and for the people" is ignoring majority opinion.

    The situation is worsened by the existence of zillions of speed cameras, which rigidly enforce these limits as an absolute, with no regard to time of day, traffic density, or weather conditions.

    Make speed limits advisory instead of mandatory, scrap the cameras and replace them with proper traffic patrol police (not the plastic Highways Agency variety), and you'd see better standards of driving, as well as a return of the public's respect for the police.

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx.     You can't do that because of all the arrogant drivers who will "think", I can drive at 90, when a reasonable driver will realise that safely it should be 60.
    You will have idiots who will drive past schools at 70 instead of what would/should safely be 20-30.

    It is the old rule, the minority will spoil it for the majority.
