payless the council have a copy because i am on housing benefit and he didn't ask for a deposit because i was recommended to him and i had no money for that just 4 weeks in advance. silvercar he will be bothered its really worrying me! the friend who knew my landlord (ish) is no longer my friend!
i am going to find or get a copy of my contract cos if i'm allowed 3 months then that is what i am entitled to unless it has one of those clauses, but i doubt it cos it is just one of those standard bought ones.

yes moneysavinmonkey landlord told me months ago he would want flat back after 12 months 9he has not stuck to that) so i put my name on the list. I dont think i'd need to get a council flat but just in case. now i'm more worried! my contract ends in november i will move out then do you know why he has to go to court when contract has expired. i'm confused sorry!0

even when the contract expires and you are supposed to move out the landlord is not allowed to enter the property and remove you - you still have some rights to remain in the property... he then has to go to court to get an eviction order etc.
To be eligible for council housing you usually need to go through the whole process. I don't know why the council rules are like they are - I don't have experience of this myself, just from what I have read on these forums. You are best to telephone or make an appointment with your council and go and discuss your options. Shelter can also help you if you need some immediate + free advice their number is 0808 800 444
If you are now financially in a position that you can afford a private rental, it might be the easiest + most stress free option to just start looking now for somewhere to move to - as it doesn't seem like you are happy where you are so there is little point in fighting to stay put!0 -
When he says he's serving a S.21, he might just mean he's serving it to take effect when the AST ends.0

can a LL claim the costs of court / baliffs from a tenant
Yes they can. But getting the money back is easier said than done, especially if the LL has no idea where the tenant is living or if the tenant isn't working. More hassle than its worth pursuing it. Happened to me. I was owed over £3k and the house was trashed but just had to write it off. The LL won't bother throwing good money after bad chasing up a small amount. Don't worry about it.
On the section 21 notice there will be a date when the LL requires possession of the property. The S21 has to be served at least 2 months and a day before the AST is due to end. It can be served any time before that. I serve mine just after the tenants move in (5 months). It doesn't mean I want them out but just means if they are problem tenants I have already started the ball rolling for legal eviction later. The LL may just be giving you greater than 2 months notice. What date is on S21? You are entitled to stay there until the last day of your contract regardless of what he says.
Even if you refuse to move out or even do not pay any rent the land lord cannot hassle you in any way. The law is stacked in the tenants favour. You are entitled to "quiet enjoyment of the property" and if the LL doesn't you can take him to court for harassment and sue him. If he enters the property without your permission he is trespassing so call the police. Do not worry about him.
If you go beyond 22 November you will not be evicted before the New Year, especially if you are not in arrears with the rent.0
