CCJ Query

Best mate has turned up at my work today in a bit of a state - he is being threatened with a CCJ for a debt run up spread-betting. He won't tell me how much but says its a considerable amount - over £5k. He is worried about what options this will give the creditor........he says he has started to go through the process of remortgaging but they are not prepared to hold action in meantime.......Anyone with any useful advice that I can pass on ???

Have to admit to wondering if anything had been wrong, as he's been pretty quiet for the last few weeks but shocked that he hasn't said anything sooner - thought it was down to problems with his missus at home, but this explains a lot.

    I would ask him to speak to CCCS or National Debtline who can probably give him a better idea of his options.

  • Update.

    He has now received the claim form(?), stating the balance owed (including interest) which is in the region of £6.5k. He doesn't dispute the monies are owed, but is concerned to the actual outcome as he tells me he is only able to realistically offer around £75 per month to the debt - He advises me that the remortgage is no nearer being sorted as the prospective lender want to see additional documents - I've advised him to complete and return the claim form asap and give additional information to say that remortgage is in process - Anyone have any other suggestions/ideas/thoughts that may prove beneficial ? ? ?

  • Ok. So my mate has now brought me round the ccj form issued to him by the betting company - it gives the amount outstanding of £6500, and the repayment rate set at £75pm, but it also includes interest of £22,000!!!! Making a total repayable of £28500........surely this cannot be legal ????

    He is in a right state. Any practical advice welcome...

    Are you sure it is a CCJ? Is the form stamped by the Court?

    It sounds like a letter from the betting company and not from the court. Is this correct?

    Is there anything in the T&C of the site about interest or anything??

    Tell him to get a copy of his credit file (and ask if it was 6500 he bet or if it was a larger amount). You can get a copy free at experian (if you cancel within 30 days). See if there is anything showing up on there.

  • He has brought me all the paperwork - It appears that it is from the St Albans County Court, I will try and scan in a copy tomorrow to let people have a look.
