Barclaycard Problem

Hi,

I have a problem with Barclaycard who have just taken a large sum of money from my Barclays Current Account without my knowledge. I have now been left with the situation being that its a over week until I get paid again, and I now have no money for groceries and travelling expenses for work.
I have spoken to Barclaycard about this and their responce was that when I took out the card I signed an agreement saying that I agreed to let them take whatever money out of my account if I go over my credit limit and they do not need further consent from em to do this.
With this, I now have a 3 part problem and I don't know the solution.
The problems are:
1). I set up my card account online and never, as far as I am aware, signed any agreement with Barclaycard. I have checked any print offs I have for the card and there is no mention of this clause.
2). The account had the card cancelled over 6 months ago and is only active as I am paying the money off. Its been over its £0 limit for 6 months so why take a payment now, when I have been regularly making payment through my DMP with CCCS.
3). Barclays are no longer in control of the account as it was passed on to a collection agency, who themselves have told me that the money should not have been taken and it hasn't been payed towards my account.

I am very sorry for the long post, but I am really at a loss about how to deal with this one. I thought about writing to them to get a copy of any agreements I may have signed, but don't know what I would do if I did, or did not, recieve them.

If anyone can advise in anyway I would be really grateful.

Thanks,
Mandoo.

Unfortunately they CAN do this and you will have agreed to this in the Terms and Conditions that you signed with Barclaycard.

I know its too late for you now, but this is the precise reason why it is not adviseable to keep long term Credit Card debts with the same Banking Group that you keep Current Accounts \ Savings Accounts with.

However, they are obliged to leave you with enough money to live on. If you can demonstrate that you need a certain amount back for bare essentials then they should refund you. You will probably have to submit a full Statement of Affairs.

May I also suggest that you set up a new Bank Account that is not linked to Barclays and start getting your wages paid into this as soon as possible. That way Barclaycard will not be able to get their hands on your wages.

    Good Luck.

But what about the fact the debt has already been sold to a debt recovery agent, so wasn't Barclaycards problem anymore? That's the puzzling bit - if they were still acting on thier own behalf i would understand it but if the debt is now in someone elses hands it's no longer up to Barclaycard to take the repayments - or is it?

ETA: And as the OP has pointed out, they didn't use the money as a repayment anyway, so what did they use it for?
