Reclaiming VAT charged incorrectly

not sure if I have posted this on the right forum, but any help appreciated. Just built our own house. Labour and materials are zero rated for VAT. Some suppliers charged us no VAT others did which I claimed back from the VAT man. Have a problem with our windows. Originally said that we would not be charged VAT then when invoiced charged VAT at 17.5 % (£900). I argued the case but they said I had to claim it back from the VAT man. Sent in my claim to VAT man and he refused to refund the vAT on the windows as siad they should have not charged us any and we have to get the money back from them ( they just show it as a credit on their next VAT return so it does not actually cost them anything they just pay the VAT man less and give us back the VAT).

Phoned window man, very off - sent him an email with all the details from the VAT man with his name and direct phone number to confirm what I said was correct.

Over one week later and no contact I phoned window company today and he is avoiding my calls.

What can I do, as anyone else had nay experience of this. I really can't understand why he is being like this as it isn't costing him anything.

  • when i have fitted windows in new build for builders i have always charged vat .i cannot see why the hmrc will not refund you .has the installer paid the vat over

  • i assume he has paid the VAT over, he gave me a VAT invoice and I paid him by cheque.

    When you reclaim VAT on a self build you can only do it once, so you have to get everything possible on the same form. You cannot now go back to HMRC and ask for more back.
    Your only hope now is if the window supplier will refund it.
    If he supplied and installed the windows he should not have charged you VAT to start with. If it was supply only then he was correct to charge VAT.
